While working, I was a passenger in a Semi Truck accident. If I go after my employer's insurance company. Will I have to pay back workman's compensation?

What do you mean "go after" the insurance company?

If you were working, this is a workers' compensation case. Your employer is responsible for paying your medical claims without time or dollar limit (in California), as well as up to 2/3 of your weekly wage (up to the current weekly maximum benefit) for any lost time from work.
