What if I get caught in an accident with no insurance?

by beezysmith » Fri Jul 10, 2009 07:08 am

So I wrecked my car that I'm still making payments on. But I had no insurance at the time of the work. I got an estimate to get it fixed and its about $8000+. I don't have good credit to take out a loan or make enough money to pay to get it fixed. I need help!

If this is true, then you file a claim against her with her insurance company.

Who probably won't pay the claim as there are a number of exclusions that could apply.

But also, the OP should be protecting himself. To leave himself knowingly wide open for a loss in having no 1st party insurance (as required) and allowing someone else to use the vehicle is just beyond stupidity. Might as well have cut the brake line and allowed someone to use the vehicle.

The OP could file suit against the sister. Personally, if I were the sister I'd be PISSED! The OP let the sister drive the vehicle when the OP knew the vehicle had no legal right to be used. What if the sister caused an injury to someone? The sister may have been wide open for a lawsuit against her personally with no coverage.

I also fail to see how the OP could have a loan and when the insurance cancelled, the insurance company did not inform the lien holder. If the lien holder was on record as such with the insurance company, they should have been informed.

Lenders are sometimes lax in their application of forced coverage. On the other hand, the OP asserts that only "one week" had intervened ( ), which, if true, would almost certainly be insufficient time for the lender to react.

The "one week" also belies the 15-20 days grace period that usually applies to auto insurance, so there are missing details here, too.

I recently got in a wreck I was at fault I didn't have insurance but the loan company had issued insurance on my truck. Does that mean I'll pay for the other parties vehicle and my vehicle to be fixed too. I was cited for no insurance. What I be able to fight that as well. after the accident I did put insurance on my truck. Is about an hour afterwards. Can the police discovered I didn't have insurance and tell in an hour after the wreck. And I cleaned the rack on the insurance I purchased an hour after how much trouble am I in.

What insurance your lender did issue? You should have disclosed earlier that it's your lender who handles the insurance related stuffs when you were cited for no insurance. First, check with the lender to know what kind of insurance your truck had and then try to file a claim by consulting the advisor.

Most likely this is a policy only to protect against damage to the lien holders vehicle. Nothing more.

after the accident I did put insurance on my truck

Good timing.

It won't matter to the policy as, as you mentioned, they already cited you for no insurance. What usually happens at this point is that the state cancels your drivers licenses until you can 1) show proof of insurance and 2) show that you settled the claim with the other party. Of course, you will also have a fine on the citation you will need to pay. Lastly, don't count on that insurance premium staying like it is. If you licenses is suspended your future insurance premium is very likely to go sky high.

My car was flooded in one of the midwest floods. I had just moved into my new condo. This was march, date of flood. When I called my insurance they said I had been cancelled end of Nov. I had not received a notice apparently it went to my old address. I was making payments to chase at the time of cancellation, They never notified Chase. The Insurance co. said they did not know there was a lienholder. How is that possible.? If they had notified Chase they would have in turn notified me and I would have gotten insurance as i have great credit. i only pay bills i receive ,unfortunately. thanks

and the insurance company does not follow everyone around to know where they move to. It's your responsibility 1) to tell your insurance company when you move and 2) to tell them you have a lien holder (it's also Chase's responsibility to make sure they are a lien holder. On top of all of this... you did not pay your insurance bill. Did you think all of a sudden it was free?

People need to take responsibility for their own actions.

I certainly agree with this statement. Unfortunately, things like driver licenses for illegal immigrants and Obamacare are making it easier to avoid responsibility for anything.

The California legislature is actually considering a bill that would allow non-citizens to serve on criminal and civil trial juries. So much for the concept of a jury of my peers. Not only would they be non-citizens, but who's to say they would even begin to understand the basic principles of American jurisprudence, let alone speak and understand English?

There is not going to be a police report if you don't have it by now. Accident reports are written the same day as the accident and copies are available at the police station within 2-3 days. Go to the police station and pay for a copy of the report.

Force placed insurance won't cover the loss unless it was in place prior. But you have a responsibility to let the lender or the insurance company know that your vehicle is wrecked.

In the meantime, learn how to use periods and commas.
