Spoke with the atty today and after waiting for them to let me know if they heard from the other insurance (which they did a last week and failed to let me know) they inform me that the other company needed some documentation (med. records).
My atty assistant said she had included the but the other side must ahve misplaced them. So She resent them. Now I ask her what to expect next and she tells me they are STILL waiting on the 5500 form from my health insurance. Okay its been since July that they have been rewuesting this form and now its almost November and STILL no form.
I asked what could be done to get them to send the form and she says "I'll keep calling". WHAT?
That hasn't gotten anywhere since July so how long can they sit on this form? Isn't there a time period these people have to turn that form over and hasn't 4 months been adequate time?
I don't want to sound pushy but I have barely been keeping my head above water , even resorting to selling a few things to keep afloat. I am passed stressed, especially with the Holidays coming, unpaid taxes and so on.
What can be done anout this form and now that the two sides are finally talking does anyone know how much longer before I can finally get past all this? Any help what so ever would be great. |

What is a "5500 form"? If it's just a form, have you called the health provider and asked if they can send it to you?
The more work an attorney does, the less money they make. That is, if they spend 1 hour and earn $2000, they get paid $2000/hour. If they spend 40 hours and get paid $2000, they get paid $50/hour. |

Yes I called highmark back in July and always got the answering service of the lady they said could help me. Out of 5 calls I got 1 call back days later and wasn't home at the time. I left another message saying I was sorry I missed her call but she never called back. I just don't know what to do if I can't get a response and neither can the atty.
I guess what a 5500 form is according to they atty assistant is a form that my health care has to fill out and return to them proving I owe them moeny out of the settlement (lein) that they paid towards my recovery. I guess they have to show they have the right to be reimbursed.
I have tried to help myself and my case along the whole time by runnung and getting documents, then sending them to the atty (mine).
I just can not figure out what will happen ig=f highmark keeps avoiding turning in this form. |

| Call back and move up the ladder. Ask for a supervisor. If you are not able to speak to that person within 24 hours, call back and ask for that supervisors supervisor. Do this until you get assistance. |

AND DON'T STOP....also call your states dept of ins talk to the consumer assistant or advocate...ask them about this and how long the carrier has to file it or send it...i'd be telling this health carrier...''apparently you are giving up your subro right? Thanks alot for your help guys. I really hated to sound desperate herebut my goodness I have been struggling along since this accident and the moeny I lay out every month for doctors and medications is really hurting us finacially. It seems all I see anymoe are piles of medical bills that have no end. I tried putting off treatment until I could get some of them under control but ended up giving in due to the pain. It just really sucks that I was doing so great in life, working hard to finally get a real home set up and Boom...this accident spun me in the complete other direction.
i am going to be calling and calling ang calling today until someone listens to me. Thanks again. |

Okay after hours of having the phone glued to my ear I hope I finally got somewhere.
Apparently my husbands employer was the hold up because they wanted the lawyer handling this for Highmark to provide them with details why they wanted this 5500 form...guess it lies somewhere in the employer confidentiality field. An agent from Highmark (got his name) contacted their atty and my husbands employer so that as he says should get the ball rolling. According to him all the info should be at the subrogations atty desk by Friday and he will keep checking to make sure they send it on to my atty.
Knowing how much aggravation this is causing me and having heard similair promises before I didn't get off the phone until I got his name, number and extension and highmarks sub. atty direct line, contact person and ext.
I was going to call my atty and let them know I did some of their work once again but I am going to wait until the end of the week so I can actually see if the form made it to its destination. Thanks again and I will update as soon as I hear anything. |

Funny you mention that because my husband and I were just talking about this. I had already set my mind to telling them I was sick of doing their work. Its crazy that I spent a couple hours tracking down the problem
and they couldn't have put the effort into it or they would have gotten the same results I did. The real problem here is getting this case settle matters to me but usn't as important to them. I even stressed how badly I needed to get this done. I do imagine they hear this all the time but still.
Now that the other side has looked things over and requested another document does this mean everything will be moving quicker now? Does it say anything about limits? I was thinking that since they seen the list of injuries I susbstained (RSD,whiplash (severe) and my jaw being knocked out of line) that if it was a simple $15000 why would they even ask for more doc's and not just want to get it over. I am not getting my hopes up but all I can think is after med bills that are owed and the ones I am paying on..wow if that was all she had I am still in a pickle. |

| I am trying to not over think this but it just put my mind into gear when they wanted more info (med. doc) after looking at all these injuries. The RSD is very well documented and proven and so was the whiplash and dental work. It just seemed weird that they would even be interested in seeing anymore documentation had her limits been low...like I said maybe it is just wishful thinking...or a case of bad nerves wondering if I am going to get everything covered, lost wages and pain and suffering...Its truly been a long road and thanks for walking down it with me. |

Keep in mind, everything your attorney does for you is time on his/her meter. If you have to take a couple of hours making some phone calls, it might be worth it to keep the money out of the attorney's hands. You are probably just one of many cases he/she has going on. The only one who will be giving this special attention is you.
