3 car accident, I was middle car?

I was stopped at a bridge in traffic behind another car that was at a complete stop also when I was hit hard from behind by another vehicle. I called Police who was there in minutes and when the Officer pulled up First thing he said was "Hi" first name of lady who hit me , he knew her. He told the three of us to move our cars and they called an ambulance for me upon police suggestion.Police took my info and told me I could pick it up later at the Station,They never asked me for statement and by the time my husband got there 10 min we live right around the corner he said the woman who Hit me was gone! only the man I hit. There was no damage to their cars and niether one of them were injured like me. The lady's insurance company is telling me my car is a total loss and to pay my own hospital and Doctor bills! I got my info from Police at station and to fill out crash report for myself. I don't think the woman was ticketed or even cited? when she was clearly at fault? I need help on what to do I think I am getting Snowed by the police , her and her Insurance company ? I requested police report a week ago and still don;t have it . PLEASE ANYONE GOT ADVICE????

Many police depts have a time frame of 10 days for when a report is ready. Call and ask them when this report will be ready and check at that time. If it's not ready, call the officers supervisor and speak to someone who can find out what the delay it.

Typically a person would receive a citation in this type of situation (when there are injuries). Its very possible that none were issued as the officer knew the person behind you. You could press the issue but I'd recommend waiting to see what information is contained in the officers report.

The officer shows up after the fact and writes down what the people have told him/her. He/she does not make liability decisions however, the information in the report can help the insurance companies understand what happen.

The insurance company told you that you need to address your own medical bills as they need to complete their investigation before they can commit as to who is at fault. They need to see if they can get statements from each of the 3 people involved and a copy of the police report. Also, before they could pay for any medical bills, they would need to have you sign a release. They don't pay medical bills on an ongoing bases. They make a payment to settle the entire injury claim (make a payment and have you sign a release to conclude the that portion of the claim).

The key in this accident is the statement from the person in front. Did that person feel two impacts (you hit them 1st and then the last person pushed you into the front person again) or one impact (you were rear ended and pushed into the person in front). There is little reason for the person in front to lie about anything as either way, they were not at fault.

Well, what Tcope has said is right, you might have to sum-up the total medical cost before you receive the claim from the at-fault driver. But before that all expenses need to be addressed either by your health insurer or by the Medpay. What exactly you have been told?

what i understand from your post was that the woman who was at fault is somehow excluded from this accident? check with the police again, and like what tcope had said, call up the superintendent if neccessary. did the police take your statement, or the statement of the man whom you've hit? because these statements will be critical in the investigation for the party at fault. from what you described, no statements were taken?!

and yes, the insurance company cannot pay out immediately because they probably have yet to receive the police's report, and thus have not conducted investigation to find out who's at fault.

As I said " the policeman knew the woman personally " and I was in the Ambulance , the officer only gave me my liscense back and that was it !when I was leaving , my husband said " the woman was gone within 10 min and the man I hit was talking to the police , but The only statement on the report was the woman " who hit me " and as far as the police , They were A_ _ holes ! excuse my french !!!!!!!

As I said " the arriving Officer new the woman who hit me " !! Personally and I was in the Ambulance when police gave me info back there was a good 10 min to get my statement, but they never did ??? and when my husband got there the Woman was gone and the man was just leaving ( who I hit ) when I went to get police report only her statement was there and not the man's and certainly not mine since I was not asked ??? They said It was too late to give a statement because they don't go back and change reports ??? really ?? so A holes ( police ) !!!!!!!! :shock: :? :evil:
