When you have an auto accident and are not covered

If you own a car you need auto insurance. You are required to buy at least the state minimum auto insurance. In a situation when you get involved in an accident and get injured your auto insurance can pay for the treatment. Health treatment costs can be very expensive and if you have to bear them out-of-pocket, it can put you in a difficult situation. Being an un-insured motorist in a situation like this could land you in a lot of trouble.

What protects you when in an accident?

Bodily injury liability insurance would cover for any injury that you cause to the third party. If you have liability insurance, you don’t need to pay out-of-pocket unless your liability is insufficient. This policy will also protect you against a lawsuit if the third party decides to sue you. Bodily injury liability coverage will protect you from expenses that include:
  • Loss of income
  • Medical expenses
  • Medical services
  • Legal expenses
  • Emergency aid
  • Funeral expenses
  • Other expenses (related)
Property Damage Liability covers you when you damage the other party's property and helps pay for:
  • Damage repair or replacement costs for stationary objects
  • Repair or replacement costs for vehicle
  • Damage to the home's structure
Collision Coverage pays for repair works to your car or in case your car needs replacement when you are involved in an accident with other cars or any stationary objects.

Comprehensive coverage pays for losses caused by natural disasters, theft covered under your policy.

Underinsured/Uninsured Motorist Coverage pays for your losses when you get involved with a driver who has little or no insurance on him.

Personal Injury Insurance pays for any injury caused to you as a result of an accident no matter whose fault it might be.

My husband was in a car accident today. He was traveling west bound and had a yellow light. The other car was traveling southbound and struck him on the drivers side door. No one was injured. However both cars were towed. We are both unemployed and our insurance lapsed in October. It is my car but we were both insured on it. Since he was driving who is liable? Me or my husband? You are going to be held responsible for the damage of the other person (if your husband was at fault) just as if you had insurance.

is he going to lose is drivers licesne?

Possible but unlikely if you reported to the police that you had insurance and could produce a valid policy. Once the other person finds out you did not have insurance they could report this to the PD and it's possible that the state may suspend your husbands license until he can confirm that the other person's loss was addressed.

he did not give them the policy number or card cause he had just changed walets so he didn't have it with him, he just told them who it was with, and the officer gave him a form that is supposed to be filled out by the insurance

I did call my insurance today and told them about the accident and from the info on the accident repor the owner of the other vehicle stated that they also used the same insurance company as us, and they have not filed a claim. how long do they have to file one?

Depends on the statute of limitations in your state. Could be anywhere from 1-4 years.

It is highly unlikely that your husband will lose his driver license as a result of this incident. But he could certainly be subject to a citation for failing to have insurance, since that is an offense in almost every state. Not to mention the loss of his employment for not having insurance as required.

Your husband should contact the other party and settle the matter privately. It will probably come out of your allowance for the next few years.

if i have a car accident with no insurance, the other party choose to sue me but i cant afford an attorney and they choose and they chose to sue their insurance company for uninsured motorist what am i accountable for

You owe 100% of the damage you caused. Property damage, personal injury damages (medical, pain & suffering), and the attorney's fees when they sue you and win.

And how much was the insurance you decided was too expensive and chose to drive without?

I'm sorry, but people who need auto insurance and fail to obtain it because "it's too expensive" should NOT BE DRIVING around town. Take the bus. Ride a bike. Walk.

You make the cost of insurance HIGHER for all of us. I don't like paying high premiums for insurance either, but I do it because it beats the alternative . . . which you are asking about today.

My daughter bought a truck at a buy here pay here place. When they did the paperwork with her they did not explain everything, just had her sign. She signed that she would cover the car with insurance but she didn't because they didn't tell her she had too (she was 19 and a little stupid at that time). She eventually let the truck go back to the dealer. A few weeks later my husband ran into some trouble with his car and asked my daughter what it would take to get the truck back. She had him call the dealership and see what needed to be done. The dealer said all that they needed was to catch up the payments and he could drive off with the truck. He did go catch up the payments but the dealer never questioned who he was or anything and they let him drive off with the truck. A few weeks later he hydroplaned on a wet road and totaled the truck. He called the car lot and told them, but they said the insurance would pay. My husband told them she had no insurance and they said she signed a paper saying she would carry it. Now, months later they are calling wanting payment of $9,000. We don't know what to do at this time.

You cannot fix stupid. It is hereditary.

Did your husband have collision insurance on the vehicle he was having trouble with? If he did, it might possibly cover the loss.

Other than that, stupidity reigns supreme in this post. The dealer was stupid for not obtaining insurance on the vehicle, AND for letting your husband drive off with the truck, too. Your daughter AND your husband were acting under the influence of stupid for driving around town with no insurance on a financed vehicle.

Someone owes the dealer/lender $10,000. Your daughter, your husband, or the dealer/lender. You could possibly claim "breach of contract" on the part of the dealer/lender for not obtaining the insurance their contract says they will if your daughter does not. It would take a very skillful attorney to win that argument.

We don't know what to do at this time


About the only thing you can do is attempt to negotiate a lower price for the vehicle, and pay that amount of money to the dealer. Be sure to get a receipt for the money.
