I was hit very hard bt a tractr trailer in the reat of my husbands van. It totaled the van and I was taken to the hospital. I spent the night and they found a tumor which I feel was aggravated by the jolt I took because I swoll way up after that. They paid for the van but do not want to pay me. What can I do about this?

In what way is a tumor aggravated by an auto accident? I as an adjuster don't understand that so perhaps you want to supply medical information to confirm this.

If they found a tumor while treating you for injuries sustained in the accident, I'd thank God that it happened. That being said, the insurance company will be responsible for your medical expenses as they pertain to the accident. The accident must have caused your injuries...an accident cannot cause a tumor.

The hospital services will be very closely scrutinized and the bills will most likely be paid by a combination of your health insurance, and the trucker's insurance.

You state that the company doesn't want to pay you...so it sounds like you may be looking for a settlement or compensation. You may or may not be awarded anything, but either way it will have to be taken to court (more than likely). If you feel that you have a strong case, and that there is more information than you have given us...you may want to hire an attorney to represent you.

Have you sustained any other injuries from the accident? I think it'd be hard to establish that the tumor has swelled as a result of the impact, more so when its only diagnosed after the accident. The initial status of the tumor wasn't known, right?

Sound to me like you are one lucky accident victim! As prior posts have stated, they will owe you for the ambulance trip, and any treatment from injuries CAUSED by the accident....now if you already knew about your tumor (why hasn't it been taken out by the way? Confused )... and thought, 'id better go to the hospital and have my tumor checked out since we got in this accident' different story...did you have any follow up treatment after your night in the hosptial if so what was it?

What EXACTLY is the ins company saying regarding your medical?
