I got rear ended in an accident with no insurance the other parties insurance won't pay for my car repairs what do I do.

How do you find out if you purchased Gap coverage when you purchased your car?


You look at your policy's DECLARATIONS PAGE to see if it is included as part of your coverage.

What if the other party has not admitted coverage, yet they rear ended you? Their insurance wants the police report before sending out an adjuster, is that reasonable?


Unless there were injuries as a result of the collision, there is no requirement for a police report to be made, and the insurance company cannot delay investigating a claim on the basis of no police report. Besides, if they want a copy of the police report, they can get it themselves.

Can a police report be amended?


Do you mean falsified after it has been submitted? That would be a problem.

Recently a vehicle hit me full force from the back while I was at a red light. Luckily it did not do much damage to my vehicle. The gentleman gave me his name, address and phone numbers and asked that his insurance co. not be notified so his insurance would not go up. Said he would pay for damages. Now, I am finding that I will need to go to the doctor's as I have terrific pain in my back and neck. (there is no police report.). Do I have any recourse?

Yes, the same whether he has insurance or not. 100% of your damages. You sue him in court. Then he has to let his insurance company know about the collision. You can always file a claim with his insurance company. Chances are, he doesn't have insurance, as required by law, which means you would have to sue him to recover a dime.

Understand this, any traffic collision -- private property or not -- that results in physical damage over a certain amount ($750 in CA, may be different in other states), or a collision resulting in physical injuries to any person, must be reported by the parties involved, at fault or not, to the DMV. Insurance companies also get their information from those reports.

You are probably required by law to report this collision. Your failure to report can cause YOU to lose your driving privilege.

I was rear ended by a speeding driver trying to get home.. will I still get paid for my vehicle and my personal injuries

Who was at fault? Anyway, you are definitely going to get compensated given the conditions that you already have UM/UIM and PIP/MedPay riders included in your basic liability insurance.
