No Pay No Play
Promotes the idea that individuals who do not purchase coverage should not receive benefits. This does not allow uninsured drivers to be compensated by insured drivers. In many states uninsured drivers need to pay a certain amount as deductible before they can sue any party for bodily harm or for property damages.

You'll probably need to bear a deductible before you may file a lawsuit against the other party.
Some of us have earlier shown us through examples wherein this "No pay no play" law stands beneficial for insurance companies. To know more, go through the following thread -

My insurance was cancelled two months before the wreck .Who will I pay a deductible to I live in the state of La .Report states she is at fault .I have 2wittness .What do I do now .

If you have no insurance, you have no deductible. You own 100% of the loss. If the other party was at fault, her insurance will pay your property damage claim -- there is no deductible in that case.
You file a claim for the damage to your vehicle with the at fault party's insurance company. Because you had no insurance at the time of the collision, you cannot collect anything for "non-economic" damages ("pain & suffering"), but you can collect for things such as medical expenses and lost time from work.
