I am scared of being accused of Fraud!!!

my vehicle was hit by ice being plowed by a snow plow while I was at work and my vehicle was in a parking lot. My question is I had previous damage to my vehicle and I told the adjuster the area that the previous damage was. They wrote me a check that was about 1000 dollars under my total estimate with recent and past damage. So will this be Fraud if I submit a claim with my insurance company for previous damage that is around the same area as the recent damage? Would this look Fraudulent? Help me I dont know what to do because I am scared about getting accused of something I dont want to do???

hi i work in insurance, if your previous damage extends on to seperate panels then your insurer may only provide the cost of repair for the more recent damage, if however your old damage would HAVE to be repaired as it is in the same place as the new damage, i.e if they have to replace the panel that is damaged, then they would let you claim for both damages under one claim, as they could not avoid repairing the old damage by repairing the new damage, in which case you would be very fortunate! :-) you wont be accused of fraud (i work in fraud investigation) but the worse case scenario is that you may have to make two seperate claims or just live with the old damage. hope this helps

Hey Neil, why don't you join the community? Its free and you can surely add a lot to its knowledge base.

However, do you think that if the insurance company has to pay the insured for the previous damages it would also increase the premium rate of the insured severely?

I don't think the adjusters will accept your claim without a proper investigation. Whenever they would process your claims request, I'm sure they are gonna take a look at your claims history.
