can some one help me please?

my car was stolen from an transmission shop and the company at first said that they were not held liable for my car. I got me a lawyer and he got the ball on the road. I havn't had a car since late August and it is now late January and i still don't have a car. I have two infant children, i have had to travel with them by bus in the cold to take them to daycare, then catch the bus to work, and the same thing after my day at work is done. The insurance company seems to feel that they dont have to pay me for the inconveinence of not having a car due to lack of carelessnes on their part. should they have to pay me?

Wow I am glad it got resolved easily. I know when it comes to restoring cars it can be a guys passion..and to lose all that can really break their heart. If I would have thought back I would have remembered my brothers motorcycle was in a garage for repair and it burnt down. He had no insurance on it and it was not covered by the garage so he was out of a bike but learned a good lesson.

1.you have not cleared in your statement whether your car was at transmission shop for repairs or you were visiting/working at the place.
2. if it was there for repairs and the shop took over your vehicle for repairs i.e. you gave them the keys to work then the shop should be responsible to make the damages good.
however your insurance company even if you have only liability insurance should persue the case with the workshop to ensure their reliability of the company. but if they find the workshop without insurance coverage then why your DMV (dot) WAS IGNORENT about this. If they are not ensuring the auspects of carrying insurance then your state laws should be revised.

sorry but you're wrong..If there is no payment made (would have to be coverage to make a payment) the carrier can NOT represent them...period...

First you got to see if your vehicle is insured against theft in the policy. The company would provide you with the replacement rental car only if your policy covers it.
