Happened in the woods

I will try to explain the best I can. Here it goes
The blazer belongs to my neice and her grandmother with the grandmothers name first, The grandmother has full coverage insurance on the blazer but her granddaughter is not on the policy nor was she listed in the household. My neice let her cousin by marriage drive in the woods Thanksgiving day. The cousin by marriage didn't have a DL was supposed to get them the Monday after Thanksgiving. The 2 girls were riding in the woods and the driver over corrected herself around a sharp curve which they hit a fence and a ditch. The driver hit her face on the steering wheel busted her nose and gapped her lip open and a bad bruise on her leg she was wearing her seatbelt. The passenger my neice wasn't wearing her seatbelt and was hurt in the back they had 2 do surgery on her and replace her L1 verdbra, she is able to walk she is home as of right now her injurys are not all known. The driver got a ticket for careless driving and driving without a DL. Passenger my neice got a ticket for letting a person drive without a DL. Both girls have to go to court for that. What will come of the grandmother insurance company for both girls and will they pay medical bills for both girls? What do we need to do? The grandmother says she has a $50,000 bi not sure what all that means for the driver or my neice. Can anyone shed some light on any of this.

Both girls didn't see any harm in the driver driving in the woods that was the onliest reason my neice let her drive. The driver was supposed to get her DL the Monday after Thanksgiving..

I can see that i wouldn't have probably seen the harm either...(except the seatbelt thing...more on that later)..

My neice can't sue because wouldn't she be sueing her grandmother as well?

As tcope posted that won't likely be necessary...she will though be claiming against grandmas policy...'if' mis-rep doesn't come into play...did you ask grandma how she answered those questions?

The trooper said that there is no posted speed for the woods so it is 55mph.

That's funny, guess it's because it's outside a city limit maybe? In my area if it's not posted then it's 25mph, but I think that in the city..I'll have to tell my husband, that we can probably drive 55 thru our field...NOT... :P

did try to get my neice to wear her seatbelt and when they are riding around before this accident the driver which would be the passenger any other time has always tried to get my neice to wear her seatbelt. My neice would never wear her seatbelt

just a little side note here...when my kids started driving they were told if they EVER did not wear their belt or any passenger did not they would lose their car for a week each time...happen to each of them ONCE...they had 'too cool for school'' friends that didn't need to wear it, mama got wind and they lost their cars...said, 'they wouldn't listen mom' well my response (and theirs after losing their cars) was 'no belt get out of the car' period, end of story...they figured out as the driver they were 'da boss' and if they were stupid enough to let someone else cause them to lose their car so be it...I've been in the buisness way too long and have seen the tragic consequences time and time again...and that held as long as they were on my insurance or living under my roof...grandma could learn alittle something here re: her grand daughter that she bought a vehicle for! Pissin' off a teenager or young adult is a small price to pay when it's for their own good...

Don't take this wrong, but sounds to me (reading between the lines) that grandma maybe over indulges grand daughter A LOT... while that's common, it should'nt come at the price of the kids welfare and safety, not to mention character developement (ie giving her a car that she is making payments on, not INSISTING she wear a seat belt, likely falsifiying a contract so she can afford it)...I could be wrong, and let me know if so, but grandma is the parent figure right? have you discussed this with her?

Wow thank you both again.
No Lori I haven't had the chance to ask her that yet. I was trying to find out everything I could to help shed some light on things before I talk to any of them and I came to the right place thank ya'll a lot.
Tcope what do you think will happen to my neice she got a ticket for allowing an unaurthorized person to drive knowingly. Both of the girls go to court the sameday. This is really a helpful place ya'll have here.

I've only been to traffic court once (expired tag on a friends boat trailer, he forgot to put the decal on) and other then that have only heard about kids going. My guess is that there will be a fine involved but it's also possible that the judge may suspend her drivers license. It's really up to the judge and his/her mood (and what he finds out about the accident). Traffic court judges can be very obnoxious. Sorry, but they want to think they own the world as judges but they are stuck enforcing tickets. My recommendation to the people to go to traffic court, dress in your _best_ cloths, be extremely respectful and agree with every word out of the judges mouth. The judge probably won't know about any insurance issue as it appears the vehicle is insured. The judge will probably tell the niece how stupid it was to allow the cousin to drive and how a person needs to be responsible for a vehicle as something like this or _far_ worse can happen.

Couldn't agree with you more Tcope...seriously tell those girls to not even THINK about rolling their eyes, (I raised, and was a teenage/young girl I know the breed)...and to just keep saying, ' i'm so sorry, I've learned my lesson and I'll NEVER do this again'...
