I get it fine, and it's a good question...if the ins vehicle would STILL be a total due to the condition it is found in the ins can just give the ins. company the cost of the salvage retention...if however (let's say the repair is 4k and the ins has already got 10k for the total)...the ins would be required to either give then entire amount back and be paid for the repair, or they could just deduct the amount of ther repair (and in this case) the ins would repay their company 6k

It may well depend upon its condition. Has it suffered extensive damages? We may also wish to hear what the insurance company has to say in this regard. What is the status of your claim?

However, if the car is just performing fine with no serious damage, you may wish to retain it. Anyways, you may ask the insurance company to write it off as well, if you don't want to get it back.

If your vehicle is repairable then yes, you will have to take it back, UNLESS (and I doubt it) your carrier has already settled (paid) with you on the total loss...What condition is your vehicle in?

what if my car was stolen and recovered 2 weeks after stripped so i sold it to insurance company only the shell so title is under their name.. than a 1 1/2 later las vegas PD found my engine and transmission and i reclaimed it. what do i do now? to get a new title under my name?

You reclaimed the car back  why? I don't know of many people who would want a stolen car back. I guess the car was declared totaled by the insurer and you were paid the acv. Therefore, the recovered parts of the vehicle would also belong to the insurance company. IMO you shouldn't look into getting back the title on it rather must move along & get a new car.

Jose, not many insurers would agree upon transferring the title back. If you really want to retain a totaled vehicle you were required to inform the insurer before they take the possession. IMO its already too late. The state laws regarding salvaged cars also need to be looked into. Groundnut

Taking back a stoloen car is always risky. You never know how the vehicle was treated and what it went through before it was recovered. My sister in law had hers stolen and they found it a few weeks later. It looked okay, was just a little muddy. I believe they had to take theirs back but ended up trding it in because their once good runnung vehicle had all kinds of problems once it was recovered.
