totaled while parked

Hi everyone,
I really need help with this..
My car was hit - very badly- as an accident happened right next to it about three weeks ago. I found my car with a police report on the door.
So I contacted the insurance companies of the two people who had the accident. (I only have liability) - Both companies sent people to look at my car, they said it was totaled. But after numerous phone calls, they both are now denying that their insurer has the fault in the accident - I mean, both say that the other party has the fault and that they won't pay me anyhting. I guess all I can do now is to sue them but I don't even know if I am supposed to sue the insurance companies or the people who had the accident.

Any help will be greatly appreciated.

Oh I guess that really makes a huge difference. Gosh that really is awful. Hope the OP can get this all straightened out.

actually, here is another thing I really need help with.
the car is still sitting on the street (where it was parked) looking totaled and abandoned. Can someone suggest me what to do with it - can I get it towed somewhere that I won't need to pay, until the court thing is over? Like a body shop? or what else can I do? any suggestions?

I'm pretty sure you will have to sue the two of them individually. Talk to the court and explain the situation - there is a chance they will schedule both of "their" cases at the same time when you have your day in court.

As to your car, check with your agent. He/she might know a body shop that will tow it (probably at a cost but you never know) and keep it for you until this is all over.

If it is totaled couldn't he even get a buddy to tow it? Thats a way to save on expensive towing fees..if he knows someone. I think that it would be a great idea if they scheduled both cases at the same time. Would save from having to lose work and get it over with all at once.

Hi Lori, Thanks for all your help, and your offer to check out the value of my car. it is a Subaru legacy/outback 1997. It has 139K miles on it. It doesn't have anything extra other than what the car came with , but I just replaced the shocks



Sener, there are like ten legacy model packages for this year...GT - L - or LSI , then there are seven different wagons, if a wagon then i need to know the package if a sedan, then which one of these three is it?

There is alot to figure in when getting a vehicles value..even the condition of the vehicle. I know when an adjuster looked over my truck they even had credit card size tears marked (wasn't any, not sure where they got sooo many on seats that were like brand new) and every tiny detail.

Description: 97 Subaru Legacy outback
Body style: 4D Wagon (doesn't say GT, L, or anything else)
Options: Cruise control, automatic transmission
Drive Train: 2.5L Inj 4 Cyl 4A 4WD

sener, found the right one, but need to know the mileage....it's showing $4725.00 without benefit of knowing mileage (could add or subtract value) ...also is there any UNREPAIRED PRIOR damage? Interior seats or dash damage, rips tears? any glaring damage to the outside like big dents or rust? Also the state you are in...and the month your accident occured... Let me know...

if a sunroof is an added option then yes, if not it may add a very small amount same with the wheels
