I did not have full coberage on the car because I do not owe the bank anymore,my home insurance would not pay,even thought the car was in my yard and his wont pay even if it is his tree.

They would only pay of their insured (owner of the tree) was negligent in that he/she knew or should have known that the tree posed a threat. Usually limbs break when strong winds or a storm comes through the area. If this was the case you'd need to show that the owner knew the limb was going to break.

I'd rather believe it's wise to maintain one's car insurance even when the car is not being used for a considerable period of time. Also, your reasons for not covering your car don't seem acceptable to me.

Then, why do you need it fixed it now, anyway?



I’d agree with anon…..the reason isn’t acceptable for not maintaining proper coverage on the vehicle.

Here's a different observation perhaps.

Since the poster did not state what the acv of the vehicle is worth, you may be jumping to conclusions on whether the posters reasons are acceptable or not. Maybe the vehicle is only worth 1500 and coverage could run as much as 500 a year on the collision. With a thousand dollar deductible it would not have made any since to have insured it. One just has to weigh the risks and how much value in a vehicle you are willing to lose in case a non insured motorists damages your car or a tree falls on it.



If the bark has been falling off the tree for a year and there are additional dead limbs in the tree, I'd take my neighbor to small claims court and let the judge decide whether the home owner was negligent for failing to maintain hazards in his yard that could affect me as a neighbor.
