If my vehicle is stolen and I file a theft report advising of such and notify my insurance company that my car was stolen --- am I liable if the suspect(s) cause damage to a third party while in possession of my stolen vehilce? Is there case law for California regarding no liability?

Ouch. Yeah...if you don't take proper precautions to safeguard your property...

company refused to pay....wanna know why???? They admitted to leaving the keys in the console...homeowners wouldn't cover it either.

I doubt this was really the reason or the denial is obviously incorrect to anyone. There are no exclusions on the policy that even come close to what you mentioned.

I think it more likely that the claim was excluded as there was an indication that it had not been stolen.

Really? This how my sister in law put it. I believed it cause it sounded pretty logical..I mean if you are stupid enough to leave the keys...and in the vechicle itself??
I can't say what really happened cause I personally do not deal much with that side of the family..only at dreaded reunions but they did have all their locks changed just in case any copies of their keys were made.

Sure..just rub it in...deeper next time ..PLEASE... I think this is why I do not care much for summer. Its not so much the heat as it is the reunions. I mean I have honestly never seen a family (hubby's) have so many damn reunions. Its like as long as there is a different last name, be it by marriage, divorce or whatever it is another reason for a reunion.
I quit going to most of them years ago...I got tired of never remembering anyones name or being stuck in Wal mart for an extra hour because cousin Gertrude had a surgery last month...whatever.

Not reflective of your sister in law but an instructor I had years ago used to like to ask the class the following questions... "Do we insure stupidity?" The answer was, "Yes, all the time".

There is no exclusions for leaving the keys in your car. I've paid for many claims where the person even leaves the car running while going into the store (so it's cool when they return). Needless to say those policies were not renewed... but the claims were paid promptly.

It's a little know fact that all policys espeically auto policys do indeed cover stupidity...ask any adjuster they'll tell you.... sorry fire I'm with T no way it was denied for that reason. (leaving keys in car) we pay those always...there nothing in the policy to exclude that...well in any policy I've ever read anyway.

Hmmm..Now my head is a wondering...This is honestly first hand what they told me. Oh well if it wasn't covered..now being mean here but the family the sister in law married is always trying to something for nothing. Kind of why I don't associate with them. Here is an example:

Replaced the faucet in my sink with a better one, both in laws working, always money for them to buy "junk" but yet I hear "I really need a new faucet. I have to turn mine on with pliers. Can I have that old one you threw on the porch?" Somedays I can scream at half the people around me. Where are peoples priorities?
