water damage from a leaking pipe

IHi am a home owner. Recently I woke up to a burst pipe in the upstaris bathroom which caused water to leak between the walls and into downstairs bathroom. The water was coming out behind the tile the claim in the shower, came out of behind the vanity and half of the ceiling in the shower was wet. The insurance company denied saying it was a long term leak. The basement was also wet. You can see up between the walls to the upstairs bathroom from the basement and I never saw any water dripping until that day. The insursance said there was dried water damage but that was because we had somoone out to dry up the walls and floors, as they told us to.

The insurers usually don’t pay for water damage, if they find that it is caused due to negligence. If the insurance company has refused to pay for the damages, you can get help from an independent adjuster. The adjuster will supposedly determine whether the leakage was the result of prolonged damage or was sudden. You can contest later on with your insurer, on the basis of the adjuster’s assessment.

This is a very common problem with claims. All insurance policies are a bit different but most will have some language stating that they are not responsible for leakage or seepage over a period of weeks, months or years. That being said, it is not easy to determine how long a water loss has been going on for. There are some signs that a leak is long term, the one that I will agree with is if there is wood rot present as this does take several months to escalate to this type of damage. However, many times I see insurance companies state it is due to mold and this I do not agree with. The other thing that needs to be looked at is of course the policy as some will state 'unless hidden' while others will say 'regardless if hidden',

The other response recommending a private adjuster is a great idea as they should know how to navigate the policy and in turn look at the damages and let you know where you stand. The type of adjuster you will want to look for is a Public Adjuster (they are in most but not all states as some do not have licensing). Actually they do... all of the time. There is no specific exclusion for negligence under the HO policies. They don't cover wear/tear or things that are not sudden and accidental but "negligence"... all of the time.
