|
|
| My wife had expired insurance and backed into a car in a parking lot. The damages were around 1000 dollars, plus we are covering a rental car for the party. AT the time of rental, it was found out that the person my wife hit has an expired drivers license for 4 months. This happened in Georgia. Can the driver with no license make a claim against my wife, and does my wife have to cover anything now out of pocket? |

Yes they can make a claim. In that they were driving without a license does not change that your wife caused the loss.
If your wife did not have insurance, then yes she'd need to address the other person's entire loss herself. |

| She is definately responsible for the accident so she does have to pay, as for the other person not having a license that would be an issue for the police, they could site them for a violation there. |

| Why not have the insurance company handle it unless it is not worth the premium hike. |

| Yep.....seems like 2 different issues. You driver with no insurance would have to pay for ALL of the damages to BOTH cars and the driver with no DL would probably have to pay a fine as well...possibly never get her DL back. Depends on the Laws in the drivers state. |

Lori, its not clear whether the OP is referring to the his wife or the other driver by

It seems that the other driver too has an expired license at the time of the accident.
However, it still doesn't change the situation for the OP. His wife is still responsible for causing damages to the motorist. |

oh! I missed out that line I think Anyways, then it seals the deal for her, right?
I'm also curious to know what else can happen to her for driving without insurance? Can she get herself banned for lifetime? would it affect her insurability in the future? |

| Quote: | | I'm also curious to know what else can happen to her for driving without insurance? | Well in this case no cops so she won't get in 'that' trouble... | Quote: | | Can she get herself banned for lifetime? | no, some carriers won't write ins on someone that has went uninsured ever...but their are many more that will...In this case the OP is taking care of all the damage to the other party out of his/her pocket...which of course is the 'right' thing to do (albeit a heck of a lot more expensive than just paying your premium)...most/many states don't actually have laws requiring ins. rather they have 'financial responsibility' laws...in this particular accident the OP has met his financial responsibilty 'for this accident' I'm sure they don't have a bond filed with the state or anything | Quote: | | would it affect her insurability in the future? | absolutely it could, and it could certainly affect her premium as well...if they were a few days late and then reinstated their coverage, that's different and they'll be ok, (can't tell by post just says 'expired' could have been 'expired' for years we don't know)... _________________ "Never, never be afraid to do what's right, especially if the well being of a person or animal is at stake.
