claim after signing waiver

My co-worker's 19 yr old son rear ended a car 3 months ago. She paid the cost of repair and have the other driver signed a release of liability for future claims related to the car accident. After 3 months, the driver said his passenger is going thru a disc surgery and claim that it was because of the accident. Cost of repair was only $800 and her son's car had just scratches. Can they still go after the insurance, or sue despite the release of liability signed?

Sure...well it depends on what the release said, but I'm betting they don't have a release signed by the passenger of the vehicle right?

That driver cannot release any claims for his/her passenger..

Now, your friend needs to get ahold of their carrier, turn in the claim and beg them to help her...by covering this claim. Wouldn't surprise me a bit to see them deny it, as your friends did not up hold their end of their insurance contact by 'promptly reporting all claims' and she has clearly compromised the claim, evidence is lost (other vehicle has been repaired).....it will be her carriers decision whether or not they will cover it or not..but she/he needs to call them NOW...

PEOPLE look at this post...this is what can happen when you try to handle liablity claims on your own, without turning them into your carrier to handle for you...
