Is it illegal to bill a patient for the balance of a bill after the copay has been paid and the insurance company has paid their contracted amount?

It depends on what they are billing you for. Non-network doctor or non-covered service are two that come to mind that you could be balanced billed for.

Yes doctors can still bill you for money you owe after the co-pay has been made and the insurance company has paid their due. What you must check is if what the doctor has billed is already paid for and if you have used the service he/she is billing you for. Physicians today, no longer want to wait for their fees, they want it upfront.

It is the state laws and specific circumstances that determine whether or not balance-billing is legal. When you opt for out-of-network services, balancing-billing is fair and legal. Only if you go for in-network services, your insurance company pays the full amount after the co-payment. Here again, the state laws on balance-billing are to be considered which vary from state to state.
