i have geico insurance with full coverage and when i went to go pick up my car it clearly was not fixed properly it purred like a kitten before the accident and now it has this loud noise and the heat shilds were suppose to be replaced but they bewre not , they just thre some goop up there but didn't fix it , my question is do i sue my insurance company or the place they had fix it? i also refused to take it because it was not in the same working order as it was before the accident, what should i do?

You'd want to file suit against the shop as well as GEICO... but this a long and drawn out process and you many loose in court and walk away with nothing.

Did GEICO refer you to this shop? If so, you need to contact GEICO and let them know that the repairs were not done correctly. If this does not get results (and it probably will), file a complaint with you states Dept of Ins and move up the ladder within GEICO.

If GEICO did not refer you to the shop then you need to address the situation with the shop. Here is my _first_ question... have you spoken to the shop about this? I'm guessing since you refused to take possession of the vehicle that you have. What did they tell you? Does GEICO know about the additional damages or did GEICO already pay for these items? If they were paid for, did the shop not make the repairs that were considered by GEICO?

You need to start asking questions.

In addition to discussing the matter with the shop owner or with GEICO, your state probably regulates auto body repair shops in one or more ways. You can always file a complaint with the regulatory agency long before you ever think about hiring an attorney.

And as tcope has said, if GEICO (or any insurance company) has referred you to the body shop, they must guarantee the work is performed to your satisfaction (or at least to industry standards). Newly rattling heat shields or other parts are definitely not up to "industry standards."

Yes, the repair work has to be up to the industry standards. But is it really required to get it repaired to your satisfaction?
