Settlement Hit by a drunk

I suffered serious injuries being rear ended at about 30 mph whiplash headaches and MRI shows bulging disc in my neck. I felt alot better after about 3months and Geico offered me only 3000 Im in Pa. i have full tort and the guy who hit me was arrested my lawyer says he'll take care of it and that is extremely low what is my case really worth i exhausted my medical of 5000 is my lawyer a joke and is my case worth alot more?

What exactly does it mean? You are not satisfied with your Lawyer's performance or not satisfied with the amount GEICO is offering you. :? Furthermore, you have mentioned that the guy who hit you was arrested. Therefore, you can very well sue him and his insurance company for the pain-n-suffering.

Pls supply some more info and try to be lil more explicit with the post.

Oh God! Your injuries certainly sound painful. It's nice to know that you have recovered from them.

Well, as I understand in Pennsylvania you can sue a drunk driver for his irresponsible doing. You can charge him for your past and future medical bills, loss of income etc. If you dispute with the compensation amount offered you then need to establish it before the court with all possible documents (medical bills, doctor's prescription).

Dear buddy,
As far my knowledge goes for Auto insurance cases I've always found PA as a no-fault state & I think that signifies that none of the parties can hold lawsuits against each other.

This is partially correct, she wouldn't sue his insurance company though, would name him in the suit.

Could be that your state would consider drunk driving as 'gross negligence' and allow punitive damages to enter the picture. Your attorney would know this.

As to no fault of P.I.P., I don't know if PA is or not, but P.I.P. requires a threshold of medical expenses be met BEFORE an injury settlement comes into play, and clearly she has exceed or past the thresold, (exausted her medpay, and been made an offer from the other carrier, and an attorney took her on, none of which could've happened if----

That is not correct as you can see. I think this poster is thinking about the 'thresold' not being met.

If you are unhappy with your attorney, you need to talk to him about it, but from what you have posted I see nothing wrong with him/her at this point anyway. If you have/had more than 5k in medical expenses (course it depends too on 'what' those expenses were), then I think 3k offer was low as well. Ask your attorney what he/she expects you to get, (not what the attorneys demand will be that is alway near the moon)......
