I was involved with a third party car accident. They are calling it a low impact accident since my car had $650 in damage. However, it didn't feel low impact and I was diagnosed with whiplash. I've been receiving treatment and my medical bills are approximately $4900. I'm in the process of trying to settle with the insurance company. I've been reading I should ask for 3 times my medical bills as a starting point. Should that include the payment of the medical expenses or not? What is a fair and reasonable settlement. I still have neck pain and I fly a lot for work which adds to the issue. I'm a supervisor for a multinational engineering firm. I'm never had an injury related car accident claim before and looking for advice.

The hospital billed 120k for my treatment/hospital stay therapy etc. (so far in the past yr) i have damages that will never heal like the partial loss of vision.
2 questions-
how do i bill for permanent loss, like vision and bein slower in congnative processing.
also, does third party insurance pay what hospital bills or what hospital is actually paid by my insurance.
hope i am clear on questions

I was in an accident last year July in the state of GA, finsihed treatment in October 2011 with Chiropractor. Total bills were about $4300 in which my medpay determined the treatment necessary and has paid. Both parties have StateFarm Insurance. The at fault party adjuster is offering $1000 without paying any medicals due to low impact and no physical damage to the car. I was diagnosed with back pain and whiplash by the ER who told me to follow up with a physician, Can the at fault party offset my medpay with the settlement amount at all that I have requested. I requested a total of $8000- with $4300 and medicals and $3700 bodily injury. Why would my evaluation not be reasonable?

If you were told to follow up with a physician, why did you choose to seek chiropractic care instead?
Aside from that, I don't quite understand how your "$3700 bodily injury" claim is separate from your "$4300 and medicals". You appear to be making the same claim twice. On top of that, if one insurance company has already paid your bills, you are not entitled to collect on those same bills a second time. Or am I missing something here?
Bodily injury claims are essentially measured at first glance by your medical bills and treatment -- these are known as "specific" (or "special") damages. If you are asking for $3700 as the result of "pain and suffering", those are called "general damages", and they are strictly a judgment call. In the absence of significant physical damage to a vehicle, many people (like judges and jurors) might find a "pain and suffering" claim a bit "dramatic". Not that it isn't possible. I'm just saying.
You apparently turned your chiropractic and other medical expense over to your own auto insurance company for reimbursement under your Medical Payments coverage part. That money would only be subrogated against your own health insurance (if allowed under state law -- in CA for example, medical payments are considered "excess coverage" and would only apply once you had exhausted your own health insurance benefit, or if you had no health insurance). It is generally up to your insurance company to go after the other party's insurance company for reimbursement of its expenditures on your behalf.
So we need some clarification concerning what you want to know here.

tHE ADJ. HAS OFFERRED TO ONLY PAY THE MEDS. sOFT TII=SSUE INJURIES AND 5 HOURS MISSED FROM WORK. i SENT SETTLEMENT LTR. ASKING FOR $25 (ALSO DAMAGE 2ND ESTIMATE WAS ONLY $500) MY QUESTION IS HOW DO I GET THEM TO UP THE ANTE?

I have recently fallen in love with arugula. It's not like I have never had it before but somehow I have developed a new apeipcration for it. Looks delicious with this pasta, great fall colors!
