Hello, can anyone give me helpful advice in my situation? Two weeks ago I was on my way home from work, stopped to pay the toll, and as I began to leave the toll booth was struck from behind by a large pick up truck that was going 77mph according to the police report. The truck was being chased by OPD (orlando fl police deparment). Im lucky to be alive as my car was very small (mazda rx8) and completely totaled.
What makes this all worst is that I had no insurance. I had some financial difficulties and my policy canceled for non payment. I really messed up on that one. Another thing I have against me is that the vehicle was stolen (occupied by 2 suspects that were arrested). I got a hold of the police report and looked up the driver. This same year in August he was arrested and charged with felony 3rd degree theft. should he have even been out??
Now im stuck with out knowing whats going to happen .. waiting on a lawyer I hired who says was waiting for a full police report last I spoke to him.
Is there any way I can get some kind of recovery?? Do I have any options?
Please dont tell me I should've been insured, that is something that I am very much aware of. Certain unfortunate circumstances in my life led to me not being insured at the moment.

All the cases being caused by the police where I am from have assumed no resposibilty. That means someway they are allowed to get away without being held responsible.

How would this be the fault of the police? 77 MPH on a toll road does not seem like a high speed chase. I would assume that the limit it anywhere between 55 to 65 on this road.
That being said, someone questioned that the original posted obtained an attorney. There is a route that I have seen plantiff attorneys go, not that I feel it holds much water. This stolen vehicle. How was it stolen? Did the owner leave the keys in it? Was the vehicle locked? Carjacking? Did the vehicle owner know the perp? Had the perp driven the vehicle before? As I am sure most adjusters know, a slick attorney can come up with anything to find some pockets.

Hello guys!! ..Just a lil update. My car is being covered by the banks insurance, how ever theres no 'gap' insurance so I have to pay what ever the difference may be. I finally got in contact with the state attorney (after 4 weeks of attempting to do so and waiting for a return call which I never received). He told me that the suspect hitting my car was not a 'crime', fleeing the scene was. So basically if he had caused my loss while fleeing the scene he could charge him. HELLOOOO HE WAS FLEEING FROM THE POLICE!! WTFFFF... bottom line there would not be any monetary recovery. Civil route would be my best bet. Ok so I know there is a second suspect involved in the theft they committed for which there were being chased in the first place. He would be an accomplice correct? So I asked the state attorney if he had his name (I would like to have all persons involved names if I'm gonna try to do something in civil), he told me the only name he had was that of the driver. Any suggestions on how I can obtain the second person's name?? BTW these guys (state attorneys sound like they don't even wanna talk to you). As far as the victims fund he said there is one, he would look into it and have some one call me (hmm I wonder if I should sit and wait another 4 weeks or call every day to remind him!.

Call him daily! Other suspects name should be on the police/incident report right?

I have a copy of the police report which has only the name of the driver. Its the accident police report though so it only shows driver of car 1 (suspect) and driver of car 2 (me). Its says nothing about the chase or their crime.
I know there has to be another report .. an arrest report or something. Maybe the arresting officer, but when I tried calling a lady told me she can't give that info.

Yeah Rod, sometimes you can't get these types of reports....the D.A. won't give you the info? Should be a vehicle theft report, that should/might list it....Call or go to the records dept of your police dept, and TURN ON THE CHARM....you know 'poor nice kid, had all this happen to him, and all I'm trying to do is be a nice upstanding young man'' you get the drill...and see if you can't get some help...(I'm serious about that you'd be surprised the reports I've got this way, you have to make them want to help you!)....

The report should be public record, but only after the authorities have released it. They may not release it until the case is resolved, which as you know could last a while. If they are building a case agaist the other person not named, the last thing they want to do is have some guy contacting him with a civil matter.
Another thing to think about is that these guys are criminals..... what is your loss after the bank's insurance covers a portion? Is it worth it to have your name and personal information out there with these guys if you pursue a civil matter. Right now you are just some person they hit.... if you pursue them.... you never know. I understand that its your money (and I would want it back as well), but if it not much is it worth it.
