How long does it take

Finally my atty seems to getting ready to settle my case. They informed me they had more than enough to get a settlement. Now my question is how long does this process take? They were in the process of gathering the last of my records. My family doc sent their records to my atty back on May 9 and the Regional pain facility I am still doctoring with (RSD) has sent their records recently also. The atty said once they got all this they would prepare a report to send off to the adjuster and wait for a response. Work is not working out for me very well and I am losing the battle of bills and struggling to stay a float. I would just like to know when I can approx. know anything. I asked the atty and they said they would contact me when they heard anything.

The SS thing is really something I have decided to wait on. I just have enough stress right now and I have heard my husbands income will count against me and other things like I won't be able to have my name on our checking. I don't know if any of this is true but I just don't feel like starting another nightmare until I am through with this one.
I have no clue about policy limits and the atty doesn't seem to either.
I just can't understand if they are only waiting on one document what that has to do with putting a value on my case. I know any med bills (doc. we are waiting on) will have some impact on the amount but surely they have an idea. If so they aren't saying. I feel like I am just a small fish in their sea of clients and that there is more they could be doing to get this done.
If the document isn't back couldn't my atty call the health co. atty and ask where this document is? I wouldn't be sooo stressed if I wasn't facing so many problems like employment and the two credit card loans we had to take out last year because of this accident. They were zero interest for one year and I have barely got anything paid. They will be approaching the year mark real soon. All that and more trigger points coming soon has got me worked up. Once this settlement is all said and done at least the TPoints will be covered at 100% with out worrying about payback. Thanks for your help. My plan so far is to keep calling every two weeks and possibly e-mailing my attyso maybe I can get some straight answers.

If it were me and the attorney said they were waiting on one form I would ask when did they request it what exactly is it, and give me the phone number for someone to call...then i would call that person, and say, 'hey i need that yesterday! what is the hold up?' period....although this is what you are paying the atty for, at the same time, if you have some control you won't be so stressed...if they aren't doing their job then i'd be 'helping' them do it, if i was in a hurry to get this moving. should embarrass them as well.. :wink:

I didn't know that I could do that. I think Monday I will call and do just as you said.I have also been thinking and I plan to tell them I am not happy with the progress they are making and think that things could be moving along a little quicker than this snails pace. I am also gona let them know that I am unhaooy with the way I am being kept updated. In other words the little fish is getting really tired of waiting for them to get things moving.

Well here is the latest. They finally got everything together for my case and put it on the atty desk to look at. they said once he went over everything they would send me a letter in the mail and also let me know how much they were asking for. I got this letter Aug. 22 (Mon.). This is what it said.
Dear *****,
Please be advised that we have made our demand on ***insurance companies for the injuries you substained as a result of the accident July 2007.
We have provided ***** with undelying documentation including police report, med. records and itemized statements.
I am trying to resolve your case as quickly as possible for the highest dollar amount. We expect to recieve a response from ***insurance companies with in the next 45-60 days. I will keep you advised as this matter progresses.
If yoiu should have any questions.......and so on.

Why did they not assign a dollar amount to this claim. Does it mean they are asking for the highest possible amount or what? I thought when they sent out a demand for injuries they had to ask for a certain amount.
If there was an amount why didn't they tell me what it was ot was did they when they said "highest possible amount" I am confused. I know thats a surprise. LOL.

They more than likely just said ''policy limits'' this attorney ticks me off though, they should ALWAYS ''cc' you on ANY and ALL correspondence, regarding your claim..in other words you should get the exact copy of the letter they sent...I'd call his paralegal and tell him/her I want copies of all correspondences, now...man that's like attorney one-oh-one! :roll: :evil:

I am pretty upset with this atty myself and I will Never recommend them to anyone. A family member recommened them to me and I really regret taking their word. This was suppose to be being resoled beginning back in May. They never really moved around until recently.
I have asked for copies and it never gets me anywhere.Usually I fing they agree and then nothing comes of it. Hopefully though it is almost over and I can just get on with my life. This really is just all I want.
The 45-60 days has me really worried that this isn 't going to be resolved before all that other stuff hits and that is why I was pressing them to move. They did nothing recently that they couldn't have done when I asked back in May. Now once agaon I will pay the price.
Do you really believe it will take that long? If so I need to find a way to tranfer my debt from moving my home to a bank before the past years interest charges get added on. The zero interest for one year was helpful but I didn't have much work and also couldn't do what I use to so not much at all is paid off.
Thanks Lori so much. I know I ask alot of you and really appreciate what you have been doing.

That's probably the deadline he put on the demand...and it depends...if the packet he sent was comprehensive, and if he asked for policy limits etc...that's why you need a copy of the letter...and yes, it will more than likely take that long....sorry...See if you can transfer to another zero interest card...i get them in the mail daily (never used any but assume you certainly could)...don't get yourself in a hurry now at the last leg of this and settle short...
