How long does it take

Finally my atty seems to getting ready to settle my case. They informed me they had more than enough to get a settlement. Now my question is how long does this process take? They were in the process of gathering the last of my records. My family doc sent their records to my atty back on May 9 and the Regional pain facility I am still doctoring with (RSD) has sent their records recently also. The atty said once they got all this they would prepare a report to send off to the adjuster and wait for a response. Work is not working out for me very well and I am losing the battle of bills and struggling to stay a float. I would just like to know when I can approx. know anything. I asked the atty and they said they would contact me when they heard anything.

Well like I told you then demands and counter offers etc...generally go thru the mail and they also usually put time limits on them of 30-90 days to respond and well no body gets in a hurry honey, I'm sorry...that's just the way it goes...you've gone this long...don't get in a hurry now and 'sell yourself short'' some adjusters/company's will operate on the 'starve them out' premiss...time really is on your side....

I don't think it would be nearly as bad if they would do something about these darn gas prices

tell me about it! I actually remember buying gas during ''gas wars''! man I'm old.. :roll: :x

No never old Lori..just really wise. Thanks for getting back to me. I know I need to be more patient... it is just so dang hard with having trouble working and the stress of these bills. I'm just praying it is all taken care of by Sept cause I have loans out that have zero interest up until then. I know I won't get them paid and don't want all the back interest. I had to take them out since we had to replace my income somehow. Gonna keep my head up and pray for the best. Talk to ya soon.

Should be done by then...the key is to bug the crap out of your attorney! (I'm serious)...I'd call them every ten days or so...They'll get sick of you and move your file to the top of the heap. :wink:

That is exactly what I was thinking myself. I have to call anyway here shortly cause my personal insurance is paying the bills now and I see that they only paid $131.oo on a hospitol bill that was over $2000. I called my health insurance and asked them how the hospitol could only except that amount on such a large bill and they said since they were in-network they had no choice. I am covered at 100% with no deductible for anything hospitol related. My health ins. said they could not come after me for the remaining amount because this is what they agreed to except when they became in-network. I am just thinking WOW that is such a small amount. I mean how can they except such a little allowance on such a large bill. I just want to be sure they won't attach my settlement for the remaining amount. Health care says they can't but I just want to be sure.

They would've filed a lein a long time ago if they were going to...What (though) about your health carrier? ARe they not going to look to the ins. company for reimbursement for what they have paid out? (not the charges, but their payments)

I asked them this same question. They informed me that as long as I used all my first party benefits (auto) that they would not seek reimbursement. I have asked a couple different times and a couple different reps. I still get that same answer. So far it lokks like per "surgery" they only pay a little over $100 out. I have to call them tomorrow and see how many of these they will cover a year. I had the last shots on May 6 and need another set. Frustrating.

Thanks. I was wondering if I should write my atty a letter stating how difficult my life has became and the changes I have had to m ake. I usually only talk to an intern (I think that is what she is). I don't think he himself relizes the difference in my life now. I thought this would be something he should know while considering the settlement. Would this even matter in my case? Also I started getting the bills from all the trigger points and although they are paid by me health insurance shouldn't I send them a copy of what was paid out? I thought this was figured in when considering the pain and suffering amount. I am gonna give them a call sometime today.

It is but everything is taken into consideration...

Little late now of course, but if you arent' getting calls back from your atty or ever talking with the atty, (probably I hope! a paralegal or legal assistant rather than an intern)...then (IMO) this isn't a good atty....you need to talk to the atty at some point prior to negotiations beginning!

I asked about why when I call my atty I always get the paralegal instead. She says she handles everything up until the point of settlement. Which is why I am wondering if they are even close. They have all the docments now. I am gonna send along these other items. Than ks for your help. I got tied up today but am planning on calling them tomorrow.
