How long does it take

Your attorney should be ''cc''ing you on ALL correspondences regarding your case...you should have copies of every single letter, email, whatever they send to the adjuster...Ask the paralega specifically...when was your last contact? Did you send a demand letter? if so when? have they responded? if so when and what did it say, and why don't I have a copy!? see the line of questioning?

What people tend to forget is this atty is YOUR employee he works for YOU...treat him as such, and hold him/her accountable for what they are doing to earn thier pay.

I did call. They said I would be happy to know they are fully working on it now. As fasr as I know they have not yet sent out a demand letter. I have recieved copies of letters they sent out to my docs. I keep checking up like you said. She said as soon as they had everything together in the report they would send out a request for settlement. I didn't know I was entitled to these documents as they sent them so that is nice to know.
I noticed since I am always contacting them they are actually responding to me alot more. (Thanks to all your advise). My last question I asked was even though my insurance company is footing these bills what happens to me down the line if I lose insurance and have to foot the whole $2300. I wanted to know if the total cost of these trigger points would be considered and not what my ins. company paid. She informed me that it most definately would be considered at the original cost.
They also said I would be contacted when everything was ready to be sent out about how this has effected an d changed my life. I told her it was something I wanted included. IK am now waiting to hear from them when they get to the next stage.

Sorry I haven't been on much. Once I work its hard to get the old arm to type. I was thinking of giving them a couple weeks and then calling again. They are suppose to contact me when we go to prepare a statement from me. They do want me to state how this changed my life but it would take me forever to try and write it with this bum arm so they are gonna take my statement over the phone and include it in the forwarding documents. Does this sound right? Gonna go on a short vacation (thank u economic stimulus!!!) and gonna contact them when I return. We are leaving in a couple weeks and returning on the 5th of July. Hopefully they will have gotten somewhere by then.

Vaca was great except the atty called me on my cell and told me that my ins. company was seeking restitution for the bills they paid. That kind of put a damper on it. I was really surprised cause I spoke with the insurance company several times and they assured me that if I proved I exhausted my auto benefits that they would not ask for repayment.
The reason I asked them was I knew a lot of these treatments were adding up. I also had to go down to my dentist when I returned and get some paperwork to prove my TMJ came from the accident. That was easy since I had been with my dentist for years and years. The other thing they were waiting on was a letter from my insurance company proving I was unstacked.
They got everything except the letter from the health ins. proving they were entitled to recovery of the money they paid. Its been a month and I really hope they get this paper back so I can get this over and done. They atty says most places aren't entitled.She says they have attys that automatically send out these letters once they recieve the correspondence from my atty asking if they are entitled to recovery. Physical therapy for the whiplash went on for 4 months and that ate up alot of the auto benefits and now all this others. Med bills sure add up quick!!
Honestly I am just not letting any of this get to me or I would go crazy.
They started working on settlement back in May and now its July. It amazes me that they are just now figuring out they need these papers or they didn't send out for them sooner. My no interest loans are coming due really soon, my job has now unemployed me. The work they are doing at this time isn't appropriate for me. They feel as if I would be a "liability'. My doc still has me on limited work and weight lim itations for that arm and it is as the doc put its not gonna change.
On top of that I am afraid to keep going to get the trigger points because I need them every 4 weeks and they are sooo expensive. In the area of $1200 that my ins pays. If this settlement keeps dragging out and I keep getting treatments there won't be anything left if she had a low policy. Goodness gracious am I stressed and really tired of this whole thing.

I'm sure you are stressed out hang in there....have you considered applying for SS disability? Talk with your attorney about this..

Honestly I did think about it but I am not sure at 36 I can admit to defeat so easily. Its just everything is sooo stinking hard for me to do. With things taken 10 times as longer as they use to I just can't keep up with anything. I seem to be going through a bad depression faze and went for meds before I drove everyone away that I love. Those make me tired on top of the pain med I am taking. Nothing really takes away the pain but I will not ever take any narcotics. I choose to live my life the best I possibly can not lay on a couch drugged out. What does my atty have to do with SS if I do decide to go that route?

Can I ask a question? If you can't answer I will completley understand. I asked recently if they knew how much they were going to demand for settlement and I recieved the answer that once they had everything back they would decide upon and amount and let me know what it will be. I am kind of thinking they should already have some knowledge of what they will be asking. Can you from the facts we have talked about know in what area a starting amount would be? I would just like to have some idea just in case. I know nothing is ever written in stone but some idea is better than none. Also if I apply for ss (which I doubt I am ready to do at this point) won't any settlement count against me?

No don't think the settlement would count against you at all with SS...unfortunately a lot of people seem to need an atty to get thru the SS disability quicker...don't know why just seems to be the case...

As to the value of your claim, I'm sorry there is no way for me to even guess...What are the policy limits?
