I was recently in an auto accident ,where the driver ran the red light to make way for a ambulance that was behind her,she claims she had no other choice,however she was at a 3 lane intersection and could have pulled left or right maybe. She totaled my car.She has insurance ,at time of accident I didnt have any,So I am depending on her insurance company,Who decided that they were not taking liability. My lawyer says this,Im leaving everything in thier hands.However her insurance company hasnt supplied rental or anything. So i trust my lawyer.Is thier a good chance that this will turn in my favor,they re-submitted everything last week,and claim that her insurance company has a month to decide. Don't know where you are but I'm betting if it's a state they require insurance... which would mean liability insurance. How would you feel if _she_ did not have any insurance? Also, if the other carrier denies liability, they may seek recovery from _you_.
I could go round and round with many possibilities but if you mention what state the accident happened in, it would greatly reduce the answer. That is, we need to know what state laws apply in this situation (mainly, the negligence laws). |

I know that my state requires insurance for sure,Im in MD.However this lady ran a red light ,she caused the accident. Dosent that mean that her insurance company should be liable for my damages to my car.I am sueing them anyways,However, I need my care fixed or for them to total it out. And I need a rental. In Texas, this would definitely be her fault. Even though an ambulance was coming, she still had the responsibility to make sure the intersection was clear to enter.
If a driver does not have insurance and is hit by someone, they are still entitled to have their car fixed. I've had some customers get upset because they felt the uninsured driver should not have been on the road. But, the fact of the matter is, the other driver still caused damage to someone else's property and is responsible for the damages.
I'm not sure how MD's rules dictact this situation, but it may be something to ask a local agent.
And please, for your own sake, get insurance. |

| I am guessing if your state requires insurance than that means that you need insurance to register a vehicle. If this was your vehicle than that means that it was not legal to be on the road because of not being properly insured or tagged. |

| Hi, If she entered an intersection on a red light and hit and totalled your car she is at fault and depending on the state she will have to repair your car. Im not sure if they are required to pay as you didnt have insurance so im not sure how this will add into the problem in the state you live in. And as stated above please go out and get insurance for your own safety and others on the road. |

1st & most importantly she IS reponsible for the damage to your car.
2nd your vehicle was not street legal with no insurance which means you had no business being out there & would raise the issue of you wouldn't have gotten hit if you weren't breaking the law!
3rd: I've been hit by someone with no insurance & they were at fault. It was a heaache & I still had to come out of my own pocket. ( If you would have been at fault, how could u pay for their repairs?)
Do EVERYONE who abides by the law & pays insurance premiums & stay the hell off the road.

In many cases if the OP was 50% or more at fault she cannot recover one penny from the other party. Not having insurance has nothing to do with liability. |

I was in a car accident with an individual that was uninsured and unfortunately I had only state required insurance. My car was totalled, my insurance company only paid half the amount of what I owe on my car, and I have severe injuries. I have been going to therapy since the accident and the doctor has told me that I need to be off my feet for at least a year to recover. If you were upside down (times 2), and you didn't have gap coverage, you're just going to have to work that out with your lein holder, which of course will put you upside down again...I'd advise you getting the absolute cheapest car you can get, and dig out of this hole. Just an FYI, had the other party had insurance it would've been the same. They would've paid (and only owed) the value of your vehicle NOT your payoff.
As to your injuried (so sorry by the way). Do you have Uninsured motorist coverage? If so then that will apply to your injuries.
