my insurance company paid me excess by mistake

Hi

I had received some EDD and Unum checks when I was in disability. I was under coverage from my employer and had particularly no notion of the amount of coverage I was supposed to get for my disability.

That's what fell on my head when I came to know of their excess payment to me, which I am supposed to pay them back right now. I just wanna know if I would be legally responsible for their mistake ?

On the contrary, if UNUM would have paid you $10,000 less due to any of your faults, you would not have expected them to pay you back. You could fix up a payment schedule with them and make sure that their payments towards you are worthy of what you expect from them. I do not have a clear idea of EDD payments as such.

Incase your employer had arrived at a contract with UNUM , in that case you need to pay them back. It is reasonable for UNUM to keep a check on their payments and hence, you need to ensure that you try out all means to derive the benefits that you are entitled to get.

Wow, good for you, I do believe if you have to pay it back that they will put you on some type of affordable payment plan.
