My son was in an accident

My son was in an accident. A woman ran into him on the freeway. It was snowing, there was a big pile-up and they avoided the whole mess. When they came to a stop a woman ran into them. Her fault, correct? They filed a claim against her insurance. Long story short, they didn't pay and then turn it around on my son. They now want them to pay 6k for damages. We refused to. They are now requesting that the dmv revoke his license saying that he caused the accident. Can this happen when they can't prove he was at fault? He does not have insurance... I know not smart.

First, you never mentioned why _they_ think he's at fault. I'm guessing they have _some_ reason for thinking this... other then just stopping and getting rear ended.

Some states allow for licenses to be suspended when the person cannot prove financial responsibility. I'd recommend contacting your state DMV and see who you should contact about this. I'm guessing your son should be able to dispute the suspension.

good morning Kevin and welcome to the community...

Bad situation, don't need to tell you that....couple of questions, is your son a minor? If so who's the owner of the vehicle? I ask this because (depending on the state) they could also come after the uninsured owner, and take all plates registered to that owner, amoung other things...

We need you to tell us EXACTLY what happened in this wreck, the info you have set forth makes no sense re: how they are finding your boy at fault...They (other ins company) has to 'tell' you why...

RE the suspension of his license...If you will tell us your state we can help you with this...I will tell you that my state (MO) allows this, plus pulling owners plates and a $200 (could be more now been years since I filed state reports) reinstatement fee, and that can't even happen until you prove you've paid what you owe, (the damages caused while uninsured).there is also 'some' help....You can request an admistrative hearing, (in most states) ...in that you (and the ins company) present your evidence re: why you think you are not at fault etc...this can be done thru the mail...eventually there is a ruling and that ruling is binding re: who is at fault...this however more than likely won't get your boy off the hook for no insurance, but could get him off the hook for the 6k in damages....

Please give us more information re: the facts of loss, police report etc...

Also either your state, or you can check yourself, all state have web sites, just google, ''your state'' then dept of insurance...

Hi Kevin, when the other party's insurance company is taking things that far, I strongly believe that they have reasons for doing so. As the other posters have already mentioned, the description of the incident is quite vague. Please explain it in detail and help us see through it.
