med pay re-payment

My ins company paid my medical bills through my med pay. The accident was NOT my fault. The other ins company told me that they would reimburse me the $5000 med pay that my company covered. They are telling me now that they do not pay the med pay back to me. Whats up with this?

That's quite right....however another provision says that the insurance company can't ask for the reimbursement before you're settled with the at-fault party and are compensated suitably for the losses incurred. Pls check it with the policy document for more clarification.

This may be so in CA, Carol, but it's not in MO. Medpay is pay directly to the insured (unless they request otherwise) and is NOT subrogatible...EXCEPT if you are in accident in a no-fault state (MO is not), then PIP has to reimburse your medpay....

George give the CA Dept of Ins a quick call they will have a consumer line, and just ask that would be your best and quickest bet...I'd say more than likely it is subrgatible since they have requested reimbursment.

I was in an accident and hit by a drunk driver. I had treatment and settled with the other party. I am now being charged back the med pay by Auto Club. They are threatening to sue me.

Do I have an recourse?

Many states allow the Med Pay carrier to seek recovery. Your settlement with the at fault carrier included all of your medical bills... even the ones paid by your Med Pay carrier.
