Was in accident no insurance

I was in an accident while making a turn I was driving the speed limit and had my turn signal on. My car is a wreck and the other guy pretty much admitted fault. The police investigating the accident also said it was the other guy's fault. Here is the bad news first the accident happened in a no fault state, in addition I am an excluded driver on my husband's insurance policy so my husband's insurance company will not cover it. Please me advise the best way to proceed forward.

I only know of one state that is No-Fault for property damage and that is Michigan. If the accident did not happen in MI, then you can simply file the claim under the other person's policy. No pay/No play should not apply either as, technically, you had insurance (but it's possible if you were in a No Pay/No Play state that you may not have a right of recovery... it just depends if the carrier finds out about your exclusion or not).

Let me ask you a question... how would you feel if the driver that hit you was excluded from their policy so you could not collect for your loss? Pretty unfair, huh?

You took a HUGE risk driving a vehicle that you are an excluded driver on, wouldn't be wise to do that again...The other carrier should take care of everything if all that you have posted is correct...contact them immediately and turn in the claim.

Yup, I support what the other posters have said, you should turn the claim on to the other party's insurance. The claim shouldn't get affected by the fact that you were driving as an excluded driver on the car.

Tcope is right, except MI, no other state follows no-fault status to property damages.
