accident not covered?

I was involved in an accident the day we had told our insurance company to cancel our policy. We had planned on changing companies. We reinstated the insurance when it happend. We also recieved new insurance cards stating that we had been covered from the 24th on. The accident happend on the 30th. There saying the policy canceled at 12:01am on the 30th. There telling us they wont cover it. Do I have any leg to stand on at all? Thank you for any help.

I'm not sure about the "leg to stand on"... you'd have to post pictures for the answer to that.

I'm confused about the dates...

First, why would you call and cancel a policy when you did not have insurance elsewhere already. This does not make sense. It basically means you'd not have required insurance. Second, what was the reason the policy cancelled on the 30th? You mentioned your cancelled on the 24th and the policy was reinstated on the 24th but nothing about why it would have cancelled on the 30th. If you don't know, ask your agent why and post that information here.

The situation is indeed complicated. The policy was reinstated on 24th of the same month and the policy was cancelled on the 30th , how is that possible?

If I take the above statement as true, then it implies that you were covered at the time of the accident. The insurance company then shouldn't have any reason to deny the claim.

Tcope, I guess the policy was reinstated on 24th of the following month and that leaves the OP uninsured during the time of the accident. Well, that's only my guess and the OP is required to clarify this point.

sjohnson956, you let your policy lapse before obtaining the new one!! Have you planned to drive without insurance for a time being?

I sincerely don't feel that the insurer should take the responsibility to cover you for the losses. If you hadn't had the accident, you would have been driving without coverage now.

This incident should be looked upon as a learning experience. I'd suggest that you move on with the life, without worrying much about the ‘leg to stand'.

The insurance company might have stated the reason for denying the claim. They are required to provide the reason for denial in writing. Hence, you are required to find it out with the insurer.

However, I agree with my fellow posters, there are few areas of confusion in your narration. Please, guide us with more information, so, that we can offer specified suggestions.

Well, you have only mentioned that you got your new insurance cards which stated your new coverage commencement since 24th. Then they must be covering you 24th onwards- I mean thats what your new carrier should be doing. Under such circumstances you'd certainly need to communicate this matter to your new agent & call up the customer-care division & offer them your new-card id number. You could end up losing on it since it was too foolish on your part to have driven without coverage. But do keep us fed from here! Fatman

You can't buy or reinstate a policy AFTER an accident occurs then expect them to cover the claim...it just doesn't work that way! if it did no one would have insurance until AFTER they got in a wreck! Why on earth would you cancel a policy without already having another in place, in other words clearly driving uninsured? tough lesson...and no I'm sorry you don't have a leg or even a toe to stand on... better try and work something out with the other driver, assuming you are at fault for the loss.
