health carrier subrogating from auto accident

I was in a car wreck ... not my fault. The other driver's insurance settled with me. Then I get a letter for a subrogation Company asking me if the was a car wreck. I told them it was.They work with my health insurance to try and recover my medical cost. I called my health insurace and they said they had not paid yet and I asked them not to and that I would set up a payment plan with the hospital. They told me if the hospital sends the a claim they have to pay it. My question is who do I pay and what if they will not give me a payment plan.

In this settlement they did not pay the hospital or all of your medical bills?

Why were these hospital bills not paid by either the at fault party's company (the one you settled with)...Or your own auto medpay or pip (if you have it) or why did you not pay it when you received the settlement? That settlement (if they didn't pay the hospital direct) would've included these bills..?

If you pay the hospital right quick then your health carrier will not pay...barring that...I really need you to answer the above questions...I'm trying to figure out why the ins. carrier didn't pay them direct when you settled...most generally the hospital or doc will send a lein against your settlement assuring they get paid..or was it understood they were paying you the bill amount and you were to pay the hospital?

I thought that before a compamy could settle thay had to contact or send a form if personal health care and not auto paid the bills? Would they have not looked into this in the beginning?

No the carrier is not bound to protect the vendor at all unless there is a lein filed, (usually there is)...my guess is there was no lein and the OP said, 'just pay me and i'll pay the hospital' and that didn't happen...there is NO QUESTION (in my mind) the OP was paid the amount of the bills.

My boyfriends son was in a car accident, that was his fault. They had no car insurance. My boyfriend declared bankruptcy. Yesterday he got a letter in the mail saying a Lein of Subrogation was filed against him. What does this mean?
