If you own a car you need auto insurance. You are required to buy at least the state minimum auto insurance. In a situation when you get involved in an accident and get injured your auto insurance can pay for the treatment. Health treatment costs can be very expensive and if you have to bear them out-of-pocket, it can put you in a difficult situation. Being an un-insured motorist in a situation like this could land you in a lot of trouble.
What protects you when in an accident?
Bodily injury liability insurance would cover for any injury that you cause to the third party. If you have liability insurance, you don’t need to pay out-of-pocket unless your liability is insufficient. This policy will also protect you against a lawsuit if the third party decides to sue you. Bodily injury liability coverage will protect you from expenses that include:
Comprehensive coverage pays for losses caused by natural disasters, theft covered under your policy.
Underinsured/Uninsured Motorist Coverage pays for your losses when you get involved with a driver who has little or no insurance on him.
Personal Injury Insurance pays for any injury caused to you as a result of an accident no matter whose fault it might be.
- Loss of income
- Medical expenses
- Medical services
- Legal expenses
- Emergency aid
- Funeral expenses
- Other expenses (related)
- Damage repair or replacement costs for stationary objects
- Repair or replacement costs for vehicle
- Damage to the home's structure

My husband was in a car accident today. He was traveling west bound and had a yellow light. The other car was traveling southbound and struck him on the drivers side door. No one was injured. However both cars were towed. We are both unemployed and our insurance lapsed in October. It is my car but we were both insured on it. Since he was driving who is liable? Me or my husband? What will happen now? Will I get sued? I have to get insurance before I can get my car back from the impound lot. But legally is there anything else that will happen? I have no money and no property to speak of, how is anyone going to be able to collect on me? Can't get blood from a turnip.

If you have bumped on someone then definitely you are at-fault. Driving under influence has nothing to do with determining the fault. However, the insurance company may cover the damages caused by you to the other party, but quite likely they would drop you after this
Ok.......we have ( let's say..) Driver #1 and Driver#2. If Driver #1 hits Drivers#2 (who is driving DUI), wouldn't the 'fault' be on BOTH parties? I mean, Driver#2 was driving impaired.Posted: Fri Feb 06, 2009 11:22 am Post Subject:
TB, your posted question is being answered on another thread.
If the other guy did flee there is probaly damage to his vehicle and with the plate number they could more than likely hold him accountable.

I think a few important points to be considered are what sort of insurance policy does the other party carry, how much was the damage to his car and what is his temprament. I person like me, if covered completely, might forego the legal hassles if the damage was limited. But of course the state won't leave you or your husband for bringing the vehicle on road without insurance because that is mandatory. Your future insurance rates are also going to be quite high bcz of this gap and accident and that too without insurance. Your husband's Dl is of course at stake so be ready for some tense period ahead. I hope today you must have realized the importance of insurance.

Hello Cher,
I’d not ask you why your daughter was driving without coverage, but, yeah, he must compensate the other driver for his damages.
driver wants us to pay his deductable nd bumper repairs,
If he turns the claim to his insurer, they would pay for his damages and then would subrogate against you for the loss they have paid including his deductibles.

In the State of Texas, if your husband is found at fault for the accident he is facing license suspension until the judgment is paid in full (if a judgment is filed). In addition, he may be required to carry an SR22a, meaning he will have to pay for insurance in full, cash, for a minimum of six months. Also, with the passage of the Driver Responsibility Act back in 2003, he will be required to pay a $250 a year fine for 3 years in addition to the no-insurance fine the county imposes. And yes, you will be required to show proof of insurance to get the car out of the impound lot.
As stated in previous posts, it's much cheaper just to buy the insurance in the first place or to use alternate means of transportation.

I was the uninsured motorist due to mishap with my insurance company at the time of the accident. The officer recored the policy# wrong on the police report and I received a new policy on the same day.
Am I responsible for the other person's vehicle since they hit me but I was uninsured? What can I expect?

Larry,
what can i do>?
I'm sorry we missed your post... :oops:First of all ring that grand daughters neck! :x Most importantly is do NOT hide from the carrier...secondly, I've got a few questions to better understand the situation and provide help you'll need to answer them:
>Do you have insurance on any other vehicle?
>If so, contact that carrier and see if they will afford coverage, (i highly doubt it but worth a shot)..
>does your grand daughter live with you ?
>if not who does she live with?
>Is she a minor?
>What state are you in?
>how long ago was it?
>when did she tell you about it? I'm sure she has received letters as well, did she tell you when she got them?
>What EXACTLY happened in the loss?
>Did she have any passengers in the vehicle?
>Are there any injuries claimed?
You'll need to contact the carrier and set up a payment plan...IF your grand daughter was 100% liable for this loss...

I don't understand this statement or what it has to do with the accident or your lack of insurance, would you please clear this up?

If you were at fault yes, if you were not at fault, then no.Posted: Tue Dec 28, 2010 02:00 am Post Subject: Accident with no insurance
my husband was in an accident with one other vehicle @ the time of the accident he did not know that the insurance was lapsed (I am the one that pays the insurance) he had called me (did not tell me he was in the accident) wanted to know where the new cards were and the policy number (because he has a new job that requires insurance) right after getting off the phone I called the insurance and got it reinstated. Needless to say when my husband came home later that day I found out that he was in an accident on his lunch break. I then had to tell him that at the time we werent insured. My question is, what is going to happen. We have insurance now but didnt at the time. What are we supposed to do? is he going to lose is drivers licesne?
