That great family member is clearly at fault...and who ever owns that car is who will be paying the bills..the owners ins will pay then the owner will pay a hefty increase in premium for what seems like ever...assuming the vehicle had insurance and the drunk uncle had the owners permission to drive the car...thanks a bunch family member huh? I'd be so ticked they'd be hoping they were staying in jail till I cooled off.. :x

Please explain the circumstances a little better re: who is uninsured just the driver or the car...and did the driver have permission?

As I was reading the OP post, I was 'getting' that the OTHER driver was driving DUI...or did I misunderstand the post? TB1313: I'm assuming your family member stole the car? did you NOT have Insurance on the car?

Would there be a rate increase if it could be proven the car was not given by permission? What if the owner of the car said it was stolen? May sound rude but so was taking the vehicle in the first place, in this was what happened.

no

What if the owner of the car said it was stolen?

They would have to do more than just say so...there would be an investigation of course and if there was either permission or implied permission, there could not be theft...if they do want to pursue that avenue, theft charges would also have to be filed, which i personally would have NO problem with.

was 'getting' that the OTHER driver was driving DUI

that's what i got the relative driving the op's car was drunk and without a license or insurance....

this part is unanswered...i'm not sure if the vehicle (owned by the OP) was uninsured or the driver which of course is uninsured...

hats good to know. I myself would not have any problems filing charges if someone was rude enough to take my car. I am also glad to see they have to go further than just saying it was stolen..this way a person could not just say it to avoid charges and rate increases.
