What do I do?

Okay.
So I got a brand new Mazda 3 on 06/17/09 and it was wrecked by my friend 06/20/09. Problem is I never gave him permisson, but I had let him drive my car since I got it WITH my permission. He wrecked into a ditch and was in jail for the weekend. He was charged with obstruction, resisting arrest, and driving under suspension but was drunk and is only 20 years old yet the cop didn't charge him with driving under the influence or under age consuption. He has no license, no insurance, no nothing.
he took the car while I was asleep. Can't remember if he took the keys out of my pants pocket or had them I was sleeping so i'm not sure. So I am going to the police station to file theft charges and the cops said since I've known him for a while they will probably get him for unauthorized use of a vehicle.
I don't know if my insurance is going to end up covering ir or not, but it seems unlikely to me. Since I gave him permission to drive in the past but he was also SOBER and not DRUNK... Regardless to me I think it doesn't matter if I gave him permission a 100 times, I still never gave him permission the night he decided to drive drunk and wreck it. And if we fight it in court I can't even say Who lets a drunk person drive their brand new car because he wasn't charged with it. So I don't know what to do or what my chances are of my insurance company covering the damages. My deductable alone is 1000. Planned on finding cheaper insurance but it's too late for that now.

Have you filed charges against him?

Anyway, call up your insurer and file the claim with them. Most likely it'd be covered. But unfortunately you have to pay the deductible out-of-pocket , which you can try to recover from him later on.

Did this thing surface after the accident?

Or is it that you already knew that he had no license and was without insurance?

So, you don't seem to know the reason why he was not charged with DUI. But didn't you know the fact that he was under suspension?

I had let him drive my car in the past once with me and once with his dad. Never alone & never drunk. But I got the police report and it said he was under the influence of "something" and in the report it said at first he lied to the cops and said he didn't know who had been driving the vehicle at all. But he said he's going to try to fight it because he claims I said "ok hurry" and he had my keys but even his friend texted and said "i told dumbass not to take your car". I file charges on Monday. I just don't know if I fight him in court or if my insurance company does. All I want is my car fixed. And I don't think it's fair if he gets out of it all together. I didn't do anything wrong and if I was going to lie then I would have said I never let him drive my car, period. BUt I told the truth.. about everything. And if he gets out if it then I'm stuck with everything for something I didn't do.

I talked to him and he said that the reason he probably wasn't charged was because it was shift change and the cops didn't really feel like doing their jobs. plus he knew two of the cops
but get this.
He was drunk, under age, had a knife, and a open alcohol container and they charged him with NOTHING involving that. Never gave him a sobriety test or anything. And he threw the bottle and the knife so he wouldn't get charged with it but then the cops put it back in my car...

First... this happen a week ago and you have not reported it to your insurance company yet? Why do you think the damage to the vehicle is not covered? The damage to your vehicle is covered if he stolen the vehicle, took it without your permission or took it with your permission. The difference is if your insurance company has a right to collect the money back from the driver after they pay the claim.

I think it's time to start picking better "friends" and also you should let this be a life lesson.
