i backed into a car in a driveway. the car i hit is a 1992 vehicle. they felt they wanted more money than what the insurance offered. they want the car totaled so they can make a down payment on a newer vehicle.

Was the insurance company offering a repair amount for the vehicle, or were they considering it totaled? No matter what the people want the money for, they will not receive more than the actual value of the vehicle. They can argue with the insurance company, and I suppose they could try and sue you...but it would cost them a whole lot more than accepting the offer from the insurance company.

Please stop worrying. Chris is right the other motorist wouldn't get more than their volume of damage.
Are you worried that they might sue you in due course if they are not satisfied with the offer made by your carrier? Well, even in that case your insurer would provide you with legal assistance.
May be you would share more with us about your concern.

if they take you to small claims court it wont cost them anything if they want to sue you .. .
