Can you tell me how many years it is necessary to be employed with a company to get the eligibility for the Cobra coverage? How long the coverage is available?

My understanding is at least 25 employees required for your employer to fall under ERISA guidelines. And the eligibility continues for 18 months.

You would be eligible for the COBRA coverage as soon as you join to your employer. But the law requires that your employer should have 20 or more employees to have the cobra. And the employer is responsible for providing a COBRA notice within 30 days of the qualifying event.

In addition to that, you can use and continue your health coverage through COBRA. But you need to continue paying the premium; otherwise you will be responsible for the total health care cost.

If you were asked to leave voluntarily leave, do you qualify for Cobra?

Yes, you would qualify for COBRA benefits even if you leave voluntarily.

Normally, the company is required to make you aware of your COBRA rights before leaving the organisation. Haven't they done it?

Also, you must know that you're not required to enroll for COBRA immediately after becoming unemployed. You would have a sixty days time period before your COBRA eligibility will expire. Hence, if you can get enrolled in the health policy of your new employer within this time, you may not have to spend more on COBRA.

Thanks,
Rupert
