Rental Car Reimbursement

Hi,

I was in an accident that was not my fault. My car was not driveable after the accident (trunk would not close anymore) so when I took the car to the body shop, I received a rental car. Since my car was an older vehicle, I only had liability insurance...no rental car coverage at all. The car rental guy told me I had to get the optional LDW for $12.99/day and I signed off on it believing it would be covered since the accident was not my fault.

The other driver's insurance company did pick up the tab for the rental but apparently not the complete tab. When I got my car back after 40 days, I was charged $400 for the $12.99 LDW. Can they do this? When I was assured by the adjuster that they were covering the rental I was not told that they were not covering the whole thing!

I think they should cover the cost of the optional coverage because if something would have happened to the rental it would have been my fault. I would have also been on the hook financially since I did not have full coverage insurance. Since this whole accident was not my fault, I feel like they should pay. Am I wrong here?

I just spoke with the adjuster. She stated that they do not pay for insurance, mileage or gas on a rental vehicle and basically said there was nothing she could do for me. I get the mileage and gas part...neither of which I have a problem with. But the insurance was not something I had an option to avoid. I HAD to get the optional coverage because I only had liability coverage on the vehicle in the accident.

This really sucks. Now I am responsible for $400 in charges resulting from an accident that was not my fault?!? This doesn't seem right.

Is there anything I can do about this?

I doubt you can recover the $400 without extrodinary measures that might cost you as much. Don't know much about small claims court but that may be an avenue. Sounds like you did sign to aknowledge that you were buying the coverage, I hear that the coverage you can but from a rental car company is like free money for them so they push it.
