How do I get SSI for my husband who is fighting for his life

by chapmanstx » Fri Aug 20, 2010 05:22 am

my husband was diagnosed with hepatitis c, and he has started his treatments for it with meds that they use to treat cancer patients. they make him so sick. his treatment is supposed to last 48 weeks for the first round. He has since had to take a 3 month short term disability claim this week because he is dog sick from the meds. The side effects are depression, homicide, suicide, hair loss, weight loss, mood swings, vomiting, diarrhea and dizziness. He has been rendered unable to perform his job duties. he is the sole bread winner of our family and his disability ins only covers 60% of his income. How do we go about getting the other 40% or some help? We live in Fort Worth TX

Well, you cannot "get the other 40%" -- if a person was able to collect 100% of their pay for not working, the thinking is they might decide to remain disabled.

You would have to apply with your state's/county's social services department in order to collect other available assistance -- which could be reduced/affected by the amount of disability income your husband is receiving.

???

who'd he kill?

Applying for SSDI requires a 5 month waiting period and proof that your illness or injury is either expected to result in your death in 12 months or be irrevocable.

He has disability coverage, you should thank your lucky stars that you have it, because we get a number of people who comer here looking for something they can do after the fact.

If this is a group policy you need to be careful. Applying for SSDI could reduce those group LTD benefits. Get a copy of the group policy documents and review them carefully, ideally with someone who knows what they are looking for (experienced agent with a high degree of knowledge in disability insurance, or an attorney who specializes in disability law).

If all else fails I suppose you could do what a lot of clients and potential clients have suggested they'd do in this situation...send the wife back out into the work force. Let us know how that works out if it comes down to that.

How will my applying for SSDI affect my group LTD benefits? Does it reduce all benefits?
