Does Allstate charge a cancellation fee?

I cancelled my auto policy with Allstate back in October. They are still trying to bill me! They are now telling me that I need to provide them with a copy of my new policy before they will officially cancel my old policy (and issue me a refund). I'm in Texas. Has anyone ever heard of this before? I feel like since I cancelled my policy with Allstate - that's all they need to know. Who my current insurance company is is none of their business.

I agree with you. To ensure that we can't come back on them they should have proof that the policy was not renewed. In anticipation of that, we email the agency and informed them that we would not be renewing the policy. We also left a voicemail. In my opinion that should suffice. The have no right to any other information.

While the agent/agency should act on your notice to them, you really needed to contact the INSURANCE COMPANY instead, since that's who issued your contract, and that's who will end it according to your instructions to them.

According to the law of "agency", knowledge of the agent is assumed to be knowledge of the principal (insurer). But, if the agent never passes the information on to the insurance company, the company has no knowledge of your intent, and it does what it normally would do for anyone else.

If you have a legitimate gripe, it is with the agent, not the insurance company. Failure to pass information on to the insurer is NEGLIGENT, and is covered by an agent's Errors & Omissions Insurance. So find out from the agent who their E&O insurance company is and file a claim against the agent for your lost money.

I cancelled my allstate policy, faxed them the declaration page that they needed, my question is, my last allstate payment came out of my checking acct 6/19, and i cancelled and faxed paperwork to them on 6/20. How will the refund work? Will I be refunded the whole thing that was taken out of my checking acct the day before?

No one here can answer that question for you. You have to read the terms and conditions in your policy. Normally, you must give the insurance company five days' advance notice of a cancellation (the clock starts ticking the day they receive the notice -- if they cancel you, the clock starts ticking the day they prepare the notice).

The part of the policy discussing cancellation will disclose what your refund will be based on and what, if anything, will be withheld from the refund as an administrative expense. When the insurance company cancels you, they must refund the unearned premium in full, but when you cancel them, your refund will likely be smaller.

If the amount taken from your policy was for one month's premium, you will probably not receive a refund at all. If for more than one month, you should receive a portion back. Some companies charge a one-month cancellation fee, others charge a simple fee such as $50, $75, or $100.

Assuming the declarations page was from your new insurance company, Allstate will cancel the policy as of the start date of the new policy. If it's auto or home insurance, you'll probably be refunded for any premium paid in excess of providing coverage until the cancel date of the Allstate policy. Call Allstate or your Allstate agent, to confirm receipt of your cancel request and dec page. If the cancellation has not been processed, tell them to remove you off the automatic payment plan drafting your bank account. Within 10 business days of it being processed, you should get written confirmation of the cancellation mailed to you, and any refund due. If the refund doesn't seem enough to you, call your Allstate agent & get an explanation of the refund, or any amount due.

So does anyone here know after cancelling at allstate how long it takes them to send the refund check?

They should acknowledge your cancellation within 15 days, and send a refund within 30 days . . . assuming you even have a refund coming. What does your policy say about this?
