Can I afford unemployment benefits with disability?

I was on short term disability ,then went on for long term.my co let me go feb 10/08.if i am released to work dec.10/08 can i still get my unemployment benefits,if filed before feb 2009.

I've been laid off and have a disabling condition that may prevent me from re-entering the job market. Will I be able to collect unemployment and disability at the same time?

probably not if and when they find out. All states differ so you'll need to check with your case worker.

Generally, the answer is no. In reality, both disability insurance policies and government benefit plans, such as state disability and unemployment insurance, have language that requires what is known as "integration of benefits."

If a government benefit is mandated (such as state disability or workers' comp, or unemployment insurance) as a primary coverage, the amount that benefit pays could reduce your personal disability benefit, or require that your state benefit be reduced by your personal benefit.

Programs such as CA state disability insurance generally provide that any income from any source, including DI insurance will reduce the state benefit $ for $ first. Your DI policy would then pay its full benefit, and that would probably mean little or nothing would be paid from SDI.

Combining benefits from a DI policy and unemployment insurance usually reduces the DI policy benefit $ for $ by the UI benefit. Same is true of Workers' Comp. You get the state mandated benefit first, as a requirement of law, and your DI policy pays the difference between what it would pay on its own and what you get courtesy of state law (2/3 of your weekly wage, to a statutory limit). Could eliminate most or all of your DI payment (that's why most DI policies are "nonoccupational" -- they don't cover disability resulting from a work-related cause).

The whole idea is simple: to allow persons to collect double or triple benefits simultaneously would cause many (if not all) to consider the possibility that they could collect more money for being disabled than from their honest labor.

We call that a "morale hazard". A person develops a bad attitude toward work, and decides to sponge off the insurance providers instead. The language in insurance contracts and state laws try to prevent that from happening.

Still, our prisons have a number of residents who once thought it was very cool to get hurt on one job, start collecting workers' comp, and then go to work for someone else at the same time. Including a few former prison guards who tried to get away with insurance fraud like this.

I am having LTD with a private insurance company. May I get unemployment benefit the same time. My LTD company is asking me to find job, is that good reason enough to apply for UB

NO!

To qualify for a disability benefit, one must not be able to work according to the definition of disability in the contract.

In order to qualify for a public unemployment insurance benefit, one must be able to work and actively looking for work.

Please explain how you could be disabled and able to work at the same time?

Some who have attempted this have ended up in prison for a felony conviction for insurance fraud.

i was off work for 2 years drawing short and long term disability and went back to work. after 3 months i ended up getting terminated and filed for unemployement they said i had no money last quarters cant they go back i was their 5 years or am i sol :?

If I became disabled due to an auto accident can I receive LTD after the doctor releases me because he can do no more?
