rear ended accident and the aftermath..

by Monday morning the other drivers insurance was on the phone with us telling us we need to bring out car to a network body shop to get it fixed. We told them we would like to take it to our own shop to get it checked before we do anything. We appreciated their quick response although the car is still drivable. They seemed mad that we wanted to take it to our own guy. Why do they seem so rushed and push their car shop? don't we have the right to bring it where we want? The other thing is the rear ended accident has caused a lot of damage to the undercarriage, and they told us if they come out to adjust for us to bring it to our own guy they will only pay what is seen on site not what is under the plastic cover bumper piece. This seems shady? also they told us we only get the rental option if we bring it to "their" network body shop. any advice? Thank you!

Cars in shop, and we await what will happen next. I'm in positive thought mode that everything will just go smooth. Or maybe its just denial? I'm not sure yet.

Stay that way makes life a little easier to tolerate! I'd still inquire about reimbursement on the couple of weekend days Janice, I think you are due that...

Evening all,

My vehicle is repaired! :D It took 5 days. The insurance co. paid the entire amount even though I picked my own shop. And they paid for the rental car except for the weekend 20 dollar thing, picking it up early because had no time on Monday to pick it up. But that was a small price to pay considering i'm pleased with the repair and the lack of effort on my part to negotiate anything with the repair shop or really have to deal with the adjuster anymore then I needed to.

We had some medical bills that went on my insurance. My state being a PIP state I guess thats just how it works. Long term medical bills I have no idea about, as i'm not sure what treatment will take place in the next couple to few weeks. My son has to go for an MRI on tuesday they think he has a herniated disk :cry:
Since being in touch with my own insurance company I feel like or they made me feel like I did not need to worry.... when they exhaust our medical limit on our car insurance it defaults to our health insurance. The medical claims is also something I'm not very used to never dealt with that before.. any advice on how to handle the medical claims?... it almost seems like if I just submit to the insurance co things go smooth. anyway, I appreciate everyones help. I'm glad I had this forum to come to has been SO SO helpful to me. So thats the update!

re: your boys injury...since you are in a PIP state, talk with YOUR adjuster and find out EXACTLY how your state handles this. I ''think'' once your son's medical expenses have met your states threshold he will then be able to present an injury claim to the other carrier, and YES you want to do that....please talk to your adjuster about that...When comes time for actual settling of that claim or any other assistance we may be able to provide, please don't hesistate....

Yeah, you got your car back, that wasn't too bad as far as time without it, right. glad to hear that all worked out for you.

I hope your son feels better soon, a back injury can linger and hurt for years to come. I fell straddle on a center beam on an army excercise in 1986 and jammed up my discs, still have issues today. My MRI still reflects the damage, they put me out of the service as being medically unfit about 8 years after the accident. I stay active and that is very important or it would have disabled me even more. Hang in there, nothing I can do now but manage it.

g'afternoon all,

I spoke with our adjuster who says that once the medical benefits on our insurance exhausts it goes directly to our personal health insurance.
My son is getting his MRI tomorrow hoping that its not a herniated disk although all symptoms point to YIKES!.
Even though this is a PIP state, should I be filing a claim against the person who rear ended us insurance company? My son doesn't work so did not have loss of wages ALTHOUGH....he's in his first year of college and missed about a week and a half worth of classes. He spoke with most his professors and they are aware of the situation, he's an A-B student he has doctors notes BUT, some classes just do not allow that amount of missed time and will just be a complete loss. Guess who's paying for college? yes, my husband and I....Which means the tuition we paid we lose on, i'm starting to get more and more frustrated with this situation. College tution is not cheap.
Also, my husband and I are both in physical therapy for neck and back injuries. It seems our insurance is handling it all.... I was reading other posts from different discussions and it seems we might have been better off not having insurance, then the right party would be responsible for all of the expenses. Am I missing something here? We are very lucky in the fact we have not suffered horrible injuries like some have that I read. Anyway.. half joking about not holding insurance... We know better. So I guess my main question is: Do we file a claim against the other drivers insurance? or does OUR insurance company handle that?

all I can say to that is OUCH!!!!!!!!!!!!!!!!!!!!!!!!! My doctor told me, that things can pop up years down the road and he's trying to prevent that from happening to us.... My son is unable to recieve therapy until AFTER his MRI. He's so young, I hope that its not any disk damage he's got a long way to go... and I know personally after a certain age it doesn't get any easier to wake those bones up in the morning, let alone with disk injuries. Thanks for your pleasant posts. You DO indeed seem very "goodnatured" :D

I try to be goodnatured, but you know it is hard some days, LOL.

I hope your son is ok and that this injury won't affect him later down the road, keep him as active as possible and hopefully your doctor is giving you good advice that will serve him the best in the future.

Yes, I think so...I've scanned back thru the posts, and if it's there I've missed it, what state are you in? Let me know so I can try and find the 'particulars' of your state re: injury settlments that eclipse the PIP threshold. Some states (I believe I'm correct here) will allow you to file a claim against the at fault parties BI coverage after your pip has been exausted, others will not. This makes me think maybe yours does not,

Or maybe they only allow subrogation. So let us know the state if it's in this thread I've missed it...sorry.

Tell me about it! You're preachin to the choir sister, already been there and done that...(put a kid thru college), and still feel the pain in my wallet! And she graduated in 01! :shock: and had a partial scholarship!

Again, let us know the state and I'll try and get some information...Sounds hard to believe that your boy (at least) wouldn't be entitled to an injury settlement, but need to research that for you...

Hope that disc isn't herniated...have four of them myself, but on the upside, he's young and strong, so hopefully can recover quickly....will have him in my prayers....
