Progressive insurance claims..

Hi friends..your threads describing insurance frauds committed by 2 of the insurance giants have urged me to take up my pen & share with the community what I had encountered almost 2 years back.

Though it was a not-so-deep accident & it was the other party who was spotted for reckless driving, still it had left an impact in my mind & body. My red Mazda protege5 was waiting at the red light & so I had some time to look around & it was then that the mishap had occurred. It was a 2500 pull up truck that had a snow trailer & a snow hauling equipment attached. It hit me from nowhere & I had no time to escape a compression injury which now generates constant pain. I'd scored 6 on a measurement of 0-10. My nerves would grow fast once they got burnt. The initial use of a spinal cord stimulator have yielded good results to let me undergo an implantation.

All this while, Progressive had been a mere spectator with only a little contribution so far to get my car repaired & came up with nothing towards my bodily injuries. The bills are now up & above $35,000. Our repeated requests for a medi-scan have fallen to deaf ears..& they must have started believing that they could get away with it quite easily. Now, it is at this juncture that my hubby's insurance came to good use through paying off my medical bills. My claim has been turned off even though I've had a clean medical track. I'd like to know if there could be a specific reason why my medical exams have been turned down!

I'm sorry to say that I'm not seeking any further advice from the Progressive agents, neither am I gonna offer them any more personal information through any open platform. I'm out to seek general consumer views over this incident & generate public awareness..I'd like you guys to know that the person who hit me has a coverage worth $50,000 in order to feed my medical bills, the fees for my attorney & the wages I've missed. I've had to consume heavy pain-killer dosages that have strong side -effects to add to my misery. Now what!

Hello I was a passenger in nov 2010 accident. My girlfriend and her sister were fussing and my girlfriend over turned the car while driving. The car flipped 3 xs and slided into the medium. My right arm busted the glass and slided on the road resulting in a deep fascia road abrasion. The nurse had to scrub the CRAP!!! Outta the wound with a pad with bristles. The dr said it was a deep fascia wound which removed the superficial skin (which is a couple of layers) and would take a while to heal. Also with permanent nerve damage(i also cant feel anything around the nerve area.) It took 4 months to heal and I have a very ugly scar abt 2 inches long an t inches wide. And I have petmanent nerve damage. I got a lawyer couple of days after the accident and its now july. Its been 8 months and still no response from the progressive company on my claim my hospital bill is over 5000 dollars. My lawyer says progressive isnt ready to settle. Wtf?? Its been 8 mnths!!! Im ready to settle. How much am I looking to get?? And whats taking so long?? Any info will be grateful.

You are paying a lawyer to answer these questions for you. Talk to him about it.

The claim could probably have been resolved much sooner, and with more money in your pocket, if you hadn't gotten involved with a lawyer. Your lawyer will get 30%-40% of what you would have gotten all on your own, simply by asking Progressive for it.

How much is it worth? No one here can tell you, but you are entitled to 100% of the medical expense (if it was paid for by your medical insurance, that company is entitled to be repaid by you), any lost wages, and then your "general damages" (aka: pain and suffering), a ballpark figure could be $5000.

But you also have to consider the driver's policy limits. If she only had minimum liability limits, you claim is in line with any other claims, and the policy limits could have been exhausted long ago, which would mean you might get $0 from her insurance company -- all because your lawyer is stalling, instead of you being first to file a claim directly with the insurance company.

Contrary to what we all see and hear on TV and radio about insurance and lawyers, the wisest among us will wait to hire an attorney until we have reached an impasse with the insurance company. If we don't believe we have the ability to fight beyond that point, then we might try to find a lawyer who can argue our matter more effectively for us.

Can you provide me with information about "self insured coverage policy limits" of a rental car agency? Our work truck was hit while parked in a parking lot of a hotel in Virginia by an AVIS rented car driver. The driver was from out of the country, had no international driver's license. AVIS took 54 days to send out an Adjuster to inspect our damages and to pay for our truck's repairs. Meanwhile we were unable to conduct our normal course of our day to day business , We have requested to recover our losses and they have denied our claim. We spoke to a lawyer who indicated that they would take the case but later decided not to. Any suggestions? Thanks

If you had as much trouble with Avis as you claim, why didn't you simply file a claim with your own insurance company for the loss to your vehicle? That's what you should do now (or should have done then). Leave it up to them to collect from Avis. If they recover your deductible, you will get it back. Or was your work truck not covered for collision or uninsured motorist?

You actually mean to say that you made no other arrangements -- expended no effort -- to conduct the "normal course of your day to day business" for at least two months? I find that extremely hard to believe, unless you really had no work to do. You could have rented a replacement vehicle if that's all that would have made the difference.

Your lost wages or other business loss? Take it to small claims court. You may or may not win, that depends on the strength of your evidence. The lawyer did not take the case because it really is not much more than a small claims matter. You will have a hard time getting a judge to believe that your actual loss was more than just a day or two of income. Had you rented a replacement vehicle, you could have been indemnified for that. But 54 days (or more)?

Sorry, but I don't have much sympathy for your situation. If you believe Avis is self-insured and failed to measure up to the state's standards of fair claims settlement practices, you can always file a complaint with your state's Department of Insurance.

Long story short, I was in a vehicle that was rear ended by a Progressive customer. I declined the ambulance ride to the hospital. But after the weekend (because we were hit on a Friday night) I still was getting more sore and having more pain than even the night of the accident. Saw a docotr and a chiropractor that Monday and was under treatment from the chiropractor and seeing a physical therapist. I was called by a progressive adjuster that wanted to "see how I was doing" i explained that I was under care for the injuries due to the accident he told me that there were several forms that he needed to mail to me so that they could proceed with the claim. I was to sign them and return them. When the forms came in the mail, included in the back of 8 or so pages, there was a release of liability form. Had I signed that all of my medical bills would have then become my problem. You can't tell me that they weren't being shady!

And if you really wanted compensation for your injuries, you would be getting your treatment from an MD, not a DC.

Yeah.. There are all sorts of shades of gray. For me there are all sorts of colors in life. The MD did a cat scan, an MRI and Xrays gave me muscle relaxers and very heavy pain killers which numbs the senses and does nothing for the real problem. At least the DC provides relief even if it is temporary.

However, that was not the point of the blog. The blog very simply stated that the progressive adjuster tried to inundate me with paperwork and tried to slip in a release of liability when I was clearly under care by a MD, DC and a PT. That was the point of being SHADY. Which it is.

But then again, I am probably blogging with someone who has never been involved in a serious car accident. This is my first (and hopefully my last) car accident, but I clearly have more knowledge about how injuries work and how they affect your life than you do since this has been the vast majority of my life for the last 19 months
