Can homeowners insurance deny claim for fire

My husband and I have a second home. My husband uses that as his primary resident, and he he sometimes lives with me. Our insurance denied coverage on the house because they determined this was not his primary resident. Is this legal and what can we do about it.

If they denied the claim they should have quoted the policy language in the denial letter. What does it state?

I'd agree with Tcope that the claim denial letter must quote the policy clause based on which they have denied it.

Was the house unoccupied at the time of the loss?

Of course it's legal. You need to look at your policy and see what the definition of 'resident' and 'primary residence' are. You can only have ONE primary residence...apparently your husband did not meet that definition. What was the claim, and what did the denial letter say?

WTF? What sort of advice is that? Would you ask a plumber for legal advice? Then why would you ask a lawyer for insurance advice.

Ask the claims adjuster who denied coverage if they really haven't already explained why.

third inncident in home all seperate incidents,one lamp electric whole in floor ,,one accident welding and ember in wall, two months ago someone broke in home looks like they stayed there stole all cooper piping in home and we made a police report next and reboarded up home and next day someone broke in again and started a fire in basement,,this we done on purpose or to keep warm,,I am answering all questions and feels like I am a suspect or they are looking to get out of claim,,any andvice? thanks

Multiple fire, and/or theft claims will ALWAYS result in, an indebth investigation. Put yourself in their shoes. They don't know you...what would you think?
