If my kid is playing at a neighbor's house and accidentally damages their very expensive rug, would my homeowners liability insurance typically pay? Or would their insurance? How does that work? Thanks in advance. _________________ Register Now to have your Insurance queries solved. |

| If your son was liable, then your HO policy would provide you (liability) coverage for the damage. |

I'm in agreement with my esteemed fellow adjuster...your policy pays..... _________________ "Never, never be afraid to do what's right, especially if the well being of a person or animal is at stake. | When you are liable for the damages caused, your homeowner policy should ideally pay. However, if the neighbor decides to file the claim under their policy then their HO insurance would provide the coverage, but later on will subrogate your insurer to collect the damages. |

Hi, I think that you should solicit to pay for the damages and turn the claim to your carrier. This way, you would still be at the talking term with the neighbor and your kids may continue to visit their place to play. _________________ Register Now to have your Insurance queries solved. |

| Thats a good point but I am sure if the neighbors have kids of their own surley they would understand how something like this could happen. Just sit down with your neighbor and discuss what options there are and come to an agreement on what route you both would like to go. It shows that you are both responsible adults and will also set a good example for the children. |

Homeowners insurance provides personal liability coverage too…
In addition to property coverage, the HO2 and HO3 homeowners package policies include personal liability protection and coverage for medical payments to others.
Liability coverage protects you when you, other members of your household, or your pets are legally responsible for injury to others or damage to their property. If necessary, liability coverage will also pay for a lawyer to defend you. _________________ auto and home insurance |

Before filing a claim, see how much the repair to the rug will cost.

| Sometimes that is the wiser thing to do. Keeps the claims off your policy.. |

Hi, thanks for the input everyone. So the liability portion of my insurance should cover it. Does the neighbor have to sue me or something for that to kick in or can I just file a claim as I normally might? (I'll also keep in mind that it might not be in my best interest to file a claim).
Thanks. _________________ Register Now to have your Insurance queries solved. |

Ideally you would file the claim but do check on your deductable first and also be aware that a claim could increase future cost of protection. _________________ auto and home insurance |

Ok, first of all THERE IS NO DEDUCTIBLE on the liability coverage, so that's moot. | Quote: | | Does the neighbor have to sue me or something for that to kick in or can I just file a claim as I normally might? | No, no body needs to sue anybody just turn the claim in the adjuster will take statements from everyone and find out how much it is to either repair or replace it. Have they got an estimate yet for this? If it were me that is what I would have them do, then you can decide if you want to pay it out of pocket or file a claim. _________________ "Never, never be afraid to do what's right, especially if the well being of a person or animal is at stake. | Glad there is no deductible but won't this cause an increase to her renewal policy? Hope the poster stops back and updates us. |

Hi anonymous12345
Are you sure you want to file a claim to cover the cost of your neighbor's damaged rug? I mean how expensive was it? Do you know if your neighbor has already filed a claim with their own insurance providers? I guess you could first find out what it would take to replace the cost of the rug and then decide whether you want to turn to your insurance provider for help or just give it out of your pocket. Even if your neighbor has filed a claim with their HO policy providers, you could still offer to pay the cost to prove you're a good neighbor
Happy to help |
