Can we claim on neighbor and affects them how?

Hi My husband was helping a neighbor fall some trees that were damaged in a storm we had. Some freak thing happened and the tree fell the wrong way and crushed his ankle. Amazing nothing broke. But the bruising is severe and it infected as well. Now he needs to be off work 3 weeks at least. Can we file a claim on the property insurance and how will it affect our neighbor, we don't want to seem greedy or mean but we have a child to support and he can't work. It's really important that I also know the effects a claim has on them we don't want a war with neighbors. If it's like a car accident claim and your premium rises just a little or is it more?

Hey Sunshine,

How often do you think it would be wise for a customer to review his CLUE report? From your instances it seems that entries reported to ChoicePoint can often be incorrect.

I filed an appeal online at the choicepoint.com website.



How prompt was ChoicePoint in correcting information?

After corrections were made, I was sent the corrected copy of my complete CLUE report.


Did they just send an online report?
Or did they send you any paper work for it?


They contacted both insurers, who then had to correct the missreported information.


Did the insurers give you any explanation for their mistakes?

if you have a 2k deductible and the damage was less than that the claim would be closed without payment...doesn't make the claim or damage any less valid.



Does that mean that an unpaid claim too would continue affecting all my future premiums?

How would it harm the insurer to take off an unpaid claim off the CLUE report of the insured? No way, right? But it'd continue affecting the insured.

It wouldn't affect the claims at the carrier you have at the time, or shouldn't...but if it were an at fault claim, it could still show up as such, although no payment were made.

Let's say it was an at fault loss..like, a one vehicle accident, insured lost control and kissed a guard rail..no damage to anything but the insured vehicle and the damage was less than their (high) deductible..They still had an at fault loss right? Let's further say they've had a few of these...does that not indicate the type of risk they are?

Or is it that the updated CLUE report removed such risks?

@Kelvin - If I remember correctly, I was told it would be investigated within 30 days and it was. I would review my report yearly, just as I would scrutinize my renewal declarations pages yearly for any changes, errors, etc....
As for frequent errors, you be the judge. Here were my claims on the CLUE and number of errors.
2 comp. windshields, 1 not fault accident (rear ended), 2 at-fault accidents -- :)) one for each of my kids, 1 burst water heater with water damage. So out of 6 claims, 2 were wrong -- 33%!!!!
I think that's totally unacceptable but the only only looking out for you as an insured is you so be your own advocate.
@ Steven - I began the process online and then completed the process in writing (it's been about 3 years now so might be able to do the entire process online and electronically receive corrected copy). I was able to check the status of my investigation online throughout. Once completed, I received a printed copy of the corrected report.

Hi Steven,
Just an apology both times. An apology doesn't cut it -- errors like that should not occur. On the error with the auto accident, that was the second mishap on the same claim. The vehicle was a Ford and I had two Fords on the policy. The insurer initially attached the claim to the wrong Ford. I caught it and they had to cancel the claim and refile with different number. The error claim did not show up in the CLUE report (go figure).

What an excellent question. Truthfully, I did not notice any change in the credit report. In fact, during the auto. claim correction fiasco we voluntarily let insurer review credit and recd. lower auto ins. premium upon results of review. We monitor our credit regularly because we often relocate for employment reasons. As you know, credit needs to be tip top for last minute moves (no time for corrections and improvements).

Did all these errors affected your rates?

I'm interested in knowing what was the aftereffects of the correction. Have you experienced rate cut in your premiums after the corrections were made or it remain the same as before?
