dishwasher leaked and ruined the floors, cost for repairs as per the contractor 4k sent it to the ins company, they sent me a check. is it fraud to do the work myself for about half the cost?

It is absolutley NOT fraud...you are free to spend the money however you wish (sometimes you will need your mortage company's permission)...If the exact same thing happens and you have not made the repairs yet, then you will not get paid again of course...But nope not fraud...give the repair a try.....sorry, but I can't help but have Bill Cosby in my mind...with the tool belt straped on and Claire calling a repair man! :wink: :lol:

the contractor is mad i'm doing the work myself and said it was fraud. he said i have to pay him for his estimate

Of course he's mad....he just lost a 4k job! But it is not fraud, unless of course his name is on the draft and you sign his name, then we're into a lot of trouble... :wink: as to him charging for an estimate, well personally I think that's a little slimy, did your carrier send or recommend him? If so you shouldn't have to pay it...If not, did he tell you this when he wrote the estimate or is it one the estimate...

DESCRIPTION OF WORK:

1) Repair existing area where sheetrock has been removed by others. Install with new like sheetrock
material behind kitchen cabinet and dishwasher opening
2) Repair existing area where toe kick material has been removed by others. Install with new like toe
kick material under kitchen cabinet and dishwasher opening
3) Repair existing area where floor substrate has been removed by others. Install with new 3/8”
like material and skim coat floor to match existing flooring height .
4 ) Install new flooring in kitchen and breakfast nook area Harmonics Pad-Attached Laminated
Flooring, Harvest Oak. There are three (3) locations where we will install transitions.
Two transitions are hardwood floor to carpet and one transition is hardwood floor the carpet stair.
5) Install new baseboard trim like material using composite like material.
6) Install new Whirlpool Dishwasher: Model No. DU1055XTP. Also, install new hoses and discharge lines,
will hook-up to existing waste and supply lines.

Items 1-5 Price: $3,460.50
Item 6 Price: 627.00 [cost of dishwasher $468.25, installation cost $158.75]
=2 0TOTAL $4,087.50

EXCLUSIONS: Permits, Fees, Engineering, Architectual Design, Damage resulting from work by others, Damage to exisitng tile substrate, Mold or Fungus as well as abatement and/or treatment of condition, Condition of existing substrates, Existing water supply and waste connections, Painting, any other work not stated in above work description.

Then if he's being ugly I'd tell him, "Look buddy I don't ''owe'' you anything, your estimate says nothing about it therefore you are not legally entitled to it, (his ads probably even say 'free' estimates) but I feel a moral obligation to pay you something...I'm sending you a check for a hundred bucks...that's all if you want more you're gonna have to sue me for it, have a nice day". then I'd send the check...And forget about it....

Something that I find pretty telling is, it's fraud to him if you pay him 100 but not fraud if you pay him 200? :roll:

Not at all fraud. I did kinda the same thing. I did all the prep clean up and finish work and just had them install the flooring. Saved about $1200 doing it myself.
