Insurance License in CO with a felony??

Hi I know this question has probably been asked a thousand times but I currently have an active P & C license in Arizona I have since moved to Colorado and I want to get a license here. Problem is I have a Class 4 Felony Drug Possession conviction and to apply for a license in CO I need to give up the License in Arizona. Can you get a License in Colorado with a F4 conviction I don't believe it's a breach of trust felony as I was not convicted with the "intent to distribute" which is an F3. If anyone has experience or can point me in the right direction I'd greatly appreciate it. Thank you.

You will have to seek a Waiver under 18 USC 1033, 1034 from the commissioner of insurance. Based on your conviction and time since that event, you are unlikely to be granted a waiver. But I don't make that decision, only the commissioner does. You will have to pay the nonrefundable fees and file the required paperwork and wait for the answer.

My suggestion: try some other field of work that is not so highly regulated as insurance and financial services.

I received a bar from the NASD 20 years ago. Originally I had received a 15 day suspension and a $10,000 fine. I did not want to pay the fine. It was explained that if I took a bar then I would never have to pay the fine; however if I did not take a bar then the NASD could come after me for the money regardless if I decided to leave the industry. I asked to be barred. Now 20 years later I would like to get a Life and Health Insurance license in the state of Colorado. I am not looking to sell any type of securities. Does anyone know whether or not I would be able to get a license?

P.S. I was accused, as a manager with a series 24 license, of allowing my brokers to use misleading and deceptive scripts. Can anyone help me with the answer?

The NASD bar is problematic. You will have to disclose the action in your license application ("Have you ever had a professional license suspended or revoked?"). The offense is an "integrity" issue. The fact that this occurred 20 years ago could be in your favor. But it will be up to the Insurance Commissioner to make the final determination.

You can try talking to the CDI in advance and see what they say.

I have lived in Nevada for 18yrs. and I am enrolled in a Life Insurance class. I have a 30 yr. old felony conviction for a controlled substance from CA. They fingerprinted me today, and said they are going off to the FBI. Is it futile for me to continue with the course? Should I tell the company now before I waste my time?

A drug felony may or may not be a problem. Were you using or selling? If selling, then it could be. If using, it might not be. Only the state insurance regulator will be able to give you a final answer to the question.

The Waiver was easy to find, gather all the documents but what do you do once you are ready to submit it? Cannot find out where to send it, have made numerous calls and no one seems to know. We called DORA and they gave us a number but no one answer just a machine and it has been 3 days and no call backs. n Really don't want to lose the job. Do you have that information for filing in Colorado? Thank you
