Can a life insurance beneficiary be disputed?

Hello, I'd appreciate anyone's advice on this one being in my shoes so here it goes...

My former boyfriend and 2 year olds father had split up after I found him cheating on me. He ended up getting engaged to this girl and removed the beneficiary from me to her. Understandable if we weren't together but my daughter was left out. They broke up because he started seeing another woman. After 6 weeks of seeing her he committed suicide and never took the girl before her off as beneficiary. The policy he had taken out when I got pregnant was over the 2 year clause at this point. Legally I know that the insurance companies pay to the beneficiary pretty much no matter what. My concern was this:

My ex's mother is suing this woman and said it's for my daughter but she wants to keep it out of his estate. ( that will be going to my daughter as soul aire anyway.) She said they are negotiating a payout settlement out of court and she will then open an account for my daughter when she's 18. As guardian of my daughter, what would someone do to make sure this is going for her or if she could sue, why couldn't I? I'm confused as to what someone would or could do.

Please keep in mind that my ex's mother is all about control and money going into this. She has not always been honest with me. She is also the executor of the estate which is understandable. I was sitting back but now have been told numerous things as if I'm not doing what I should or that I have rights when it comes to my daughter in this situation. If there is anything that I should know I wanted to ask you. What would you do?

[quote:a36287d8fb]Kind of wanna to 'add' my '2 cents' to this thread. My son knows I have an Insurance policy, through the military. However...he doesn't know how much.....he's never asked, for that matter. he tells me that, "he would rather have ME than the money." He also says, "Money is nice to have, but, MOM.,..when you die, I would NEVER have you again." ( Sniff..Sniff). My son is 15 years old. This conversasion brought teears to my eyes.

I assume that your son doesn't know that he isn't the beneficiary and none of the money will be his.

Ok, Ins. expert...that's enough of that now, did you not see the thread that SD apologized after finding out that everyone here really was trying to help her, and her info was incorrect? And ASKED for help? (it's been about six weeks ago or more)

i want to apologize for my stubborness. I've been in the Military a long time. 'You' would think if the Military is giving out incorrect information, they would correct themselves. Please tell me,...........what should I do?! How should I change my Life Insurance policy so my son is PROPERLY cared for????????!!!!!!!!!!!

here's a link to that thread, the more I think about it I'm just sure you wouldn't be continueing with the jabs if you'd seen it..please check it out, I'm sure you will be happy to assist her, as you've tried to in the past, now that she is open to that help.

I never saw it. I greatly apologize for this latest jab. My jabs were always meant to prod her and to get her to take action. I'll take a look at the thread.

Hello Everlasting,

My daughter is an illegitimate child.

I'm sure that she is. However, unfortunately it has nothing to do with her being on her father's life insurance.

Do you still have the receipt that your husband had given you? Contact the insurance company as Lori has said, but most likely the insurance company wouldn't divulge the information regarding the beneficiary if you are not the one.

Hadn't your husband told you anything about you being the beneficiary in the policy?

Can't you find the policy document? It might have had the name of the beneficiary mentioned in it.

Thanks,
Rupert

I knew your intentions were the best, and your heart was in the right place for your barbs Ins. expert...that's why I thought I'd better bring that thread to your attention, so you could help her..

a, rupert...

He was never her husband hon, per her statement and your acknowledgement of that statement...

Everlasting, how old is your daughter now, and you say it was two years prior to her birth that he gave you the receipt? How long has it been since you've had contact with him prior to his death? Did he ultimately marry someone or have any other children? Did he acknowledge (legally) being father of your child?

He died recently..

Was this receipt the only paper that you'd received regarding it? What about the other paper works? Did he keep them with himself?

It does make a difference financially when part of the childs support system goes away. My sons father died jun 11th and I'm currently starting to fight his mother for my sons right to his life insurance. Its a big difference when you lose the person that helped with diapers, clothes, shoes, medical bills, etc... it hurts that he died but to me my son is more important and his welfare comes first.

my sons right to his life insurance

There is no "right" to life insurance proceeds on the part of any person who is not a beneficiary named under the policy. If someone other than your son was named as the beneficiary of your ex-husband's life insurance, your son has no claim to that money.
